According to clause (5) of Article 168 of the Constitution, which is the last option to form a government, the government was formed 142 days ago under the leadership of Karki.

Senior advocate Hemraj Pant says that whoever gets majority in the parliamentary system will form the government. He says, 'It is said that no-confidence motions cannot be brought in the provinces for one year. However, if the policy program and budget are not passed, it is morally impossible to stay in the government, the government will fail.'

According to Article 168 (2) of the constitution, the state assembly formed the first government of UML and Maoists under the leadership of Hikmat Karki on 25th January 2079. The government fell after the Maoists, a constituent party of the government, withdrew their support due to the identity movement. Koshi province was named during Karki's time.

On 22 June 2080, the government was formed under the leadership of Uddhav Thapa of the Congress according to Article 168 (2) of the Constitution. On July 11, the Supreme Court dismissed Thapa on the grounds that the Chief Minister appointment process was against the constitution. But, Thapa was appointed Chief Minister for the second time according to Article 168 (2) of the Constitution on 16th July 2080.

After the Supreme Court dismissed Thapa for the second time on August 16, according to Article 168 (3) of the Constitution, the government was formed on August 22, 2080 under the leadership of UML leader Hikmat Kumar Karki. But as there was no basis for taking a vote of confidence, Chief Minister Karki was forced to resign on October 20. After that, according to clause (5) of Article 168 of the Constitution, Congress leader Kedar Karki was appointed as the Chief Minister on October 27.

Rebelling with coalition parties 8 And Karki became the Chief Minister with the support of 39 MPs of UML. 'Now Karki's government is in the minority', said one of the provincial MPs of UML, 'There is no option to form a new government.' Stating that sooner or later there will be a change of power in Koshi, he said, 'This is a political process, we will proceed according to the party's decision.'
