TikTok filed a lawsuit against American law

The video sharing app and its parent company ByteDance have filed a lawsuit against the US government on Tuesday regarding the TikTok law that was implemented two weeks ago. ByteDance, a Chinese company, has alleged that the law, which would have faced a ban on the TikTok app if it did not sell its US market share, was unconstitutional.

Because the Chinese government can monitor American citizens or influence public opinion through Tiktok, the US has either sold the local operation of Tiktok to local investors, or else it has been politically forced to face sanctions. Tiktok, on the other hand, has been opposing the law saying that the government is an "extraordinary and unconstitutional exercise of power" that violates the freedom of expression of its 170 million American users.

"Banning Tiktok is completely unconstitutional and even the law makers have understood this," Tiktok filed in the court petition said, "Therefore, they have added provisions to regulate the ownership of Tiktok so that this law does not appear to be directly restrictive." But in fact, Tiktok has no option to choose between banning or selling ownership. Tiktok complains that the only option for ByteDynes is to face ban as it is not commercially and technically possible to sell the ownership of Tiktok's American market.

The lawsuit filed in the Court of Appeals for the District of Columbia Circuit said it was unfair to characterize TikTok's Chinese ownership as a national security risk without proof. TikTok, which was valued at $268 billion last year, has now announced that it will fight against the US government. The issue is also important to the Biden administration. Because if the government loses in this, a long strategic effort will be wasted. Likewise, if the court decides in favor of the government, there will be a change in the regulatory control of foreign-invested technology companies in the US market.

The rift between TikTok and the US government is not a new topic. During the previous US President Donald Trump's tenure, i.e. in August 2020, an executive order was issued to ban TikTok and WeChat if they were not sold to non-Chinese entrepreneurs. But just a few hours before the execution of the order, a US federal judge ordered a stay of the order, saying it violated the First Amendment of the US Constitution. After some time this controversy was raging. At that time, ByteDance was actively trying to maintain its dominance in the American market.

This is the first time in the US that any social media platform has been single-handedly banned.
