Nepali Congress parliamentary party leader Surendraraj Pandey has been appointed as the chief minister of Gandaki province.

According to the order of the Supreme Court on Monday, the Chief Minister Dilliraj Bhatt appointed the Chief Minister as the leader of the first major party in the State Assembly in accordance with Article 168 (3) of the Constitution.

Pandey went to the court saying that the then Chief Minister Khagraj Adhikari's declaration of trust vote in the State Assembly was unconstitutional and became the Chief Minister for the second time. Pandey, who was appointed the Chief Minister for the first time on 14th Baisakh, resigned on 21st February after being in the minority when the central coalition was reshuffled.

UML leader Khagraj Adhikari, who became the chief minister in Gandaki from the current ruling coalition, was unable to secure a majority in the provincial assembly as per the constitution.

But in the writ filed against it, the joint bench of Supreme Court Justices Kumar Regmi and Sunil Kumar Pokharel held that the vote of confidence taken by the Chief Minister Officer was illegal and ordered to appoint the Chief Minister within 48 hours as per Article 168 (3) of the Constitution.

According to the provisions of the constitution, Chief Minister Pandey has to take a vote of confidence from the state assembly within 30 days. Congress has 27 If there are MPs, the Congress should take the support of 4 more seats to get the majority.

There are 22 MPs from the UML, 7 from the Maoist Center, 1 from the Nepal Samajwadi Party, 2 from the RPP and 1 from the United Socialist Party of Nepal.
