It is seen that four charges will be drawn against Jeetendra, the son of former Vice President Nanda Bahadur Pun, who was involved in illegal gold transportation through a written agreement with a Chinese businessman. When Nanda Bahadur was the Vice President, Jitendra, who was appointed as the 'Vice President's personal officer' in order to get government service facilities, was brought under investigation for 4 offenses after it became public that he had smuggled gold together with Chinese businessmen.

Former Vice President's son Jitendra involved in 4 crimes

Jitendra is the eldest son of former Vice President Pun. The younger son Dipesh is the general secretary of the Maoist All Revolutionary Party. Deepesh has already been involved in crimes like gold smuggling, fake Bhutanese refugee case, co-operative fraud, mining exploitation etc. He was arrested and investigated by the police on charges of misappropriation of the cooperative's savings. Recently, with the news published with evidence of Jitendra's involvement in gold smuggling, Dipesh has also been dragged into the investigation.

When he was vice president again, he was charged with the Customs Act, Organized Crime Prevention Act, Corruption Prevention Act and activities against the national interest and the investigation proceeded accordingly. In three crimes, the police themselves can complete the investigation and submit a report to the public prosecutor's office. In the case of corruption, if the involvement is revealed, it should be sent in writing to the Abuse of Authority Investigation for further investigation.

Smuggling in Taklakot through Tamsuk, Hilsa

When Babu was the Vice President, Jitendra, who along with the smuggler, imported illegal gold many times, Kantipur published news about the 4 kg gold transaction brought by him in October 2076. Then the Deputy Prime Minister and Home Minister Ravi Lamichhane sent the Inspector General of Police Basant Bahadur Kunwar to the ministry and instructed him to investigate the involvement of Jitendra, the son of former Vice President Pun, in the gold smuggling and the smuggling network of this group. After the instructions of the Home Minister, Inspector General Kunwar handed over the investigation of this case to the Central Bureau of Investigation (CIB). The CIB has said that the investigation has progressed.

The Customs Act prohibits the importation of raw gold from abroad. According to the order issued by the government under the Customs Act, 2064, women can now bring 50 grams and men 25 grams under the title of 'Jhitigunta' and up to 200 grams of prepared gold by paying customs duty. Moreover, importing gold is considered illegal. However, the fact that Jitendra and Dipesh, the sons of former Vice President Pun and Jeevan Kumar Gurung, who was appointed as their foreign affairs expert, was smuggling gold from abroad has come to light.

Section 57 of the Customs Act 2064 states that if someone steals, exports or imports stolen goods or attempts to do so, or if they export-import from somewhere else where they are allowed to export-import only through a specific route, it is considered an offence. There is a provision of imprisonment for 1 to 3 years in such an offense and 3 to 5 years in case of an offense between 1 crore and 3 crore rupees. Jitendra's smuggled 4 kg gold is worth more than 4 crores. If this offense is confirmed, he may be charged with a misdemeanor and imprisoned for up to 5 years.

Another law that could be drawn against Jitendra is the Prevention of Organized Crime Act. Section 3 of the Prevention of Organized Crime Act-2070 states that 'no person shall commit or cause organized crime'. It has been stated that "someone who knowingly commits a serious crime for the benefit of a criminal group, on behalf of a criminal group on behalf of a criminal group, or as a founder or member of a criminal group, is considered to have committed an organized crime."

Punishment for the crime of illegal transportation of gold can add up to 50 percent. It has been confirmed by the facts that Jitendra brought illegal gold from China to Nepal by making an organized plan. It is mentioned that the person who commits this offense will be punished with an additional 50% in addition to the offense of customs fraud.

It seems that charges of crimes against the state will also be attracted against him. According to Section 51 (2) of the Criminal Code 2074, it is mentioned that crimes against the state should not be committed. Section 51 (2) of the Code states that 'no one shall do or cause to be done any act prejudicial to the national interest'. In it, it is said that if any action is taken to insult, incite or spread hatred or malice towards Nepal's independence, sovereignty, geographical or territorial integrity, nationality, independence, self-respect or Nepal's international image, action may be taken on the charge of committing a crime against the national interest. Article 61 of the Constitution states that the President shall be the guardian and custodian of the Constitution. It is also said that it is the duty of the President to promote national unity. In the absence of the President, there is a constitutional provision that all this work should be done by the Vice President. It has been said that 'in the absence of the President, the tasks performed by the President will be performed by the Vice President'.

'The fact that the Vice President's personal secretary and adviser joined the gold smuggling together with foreign gangs has tarnished, insulted and defamed Nepal's image in the international world,' an investigation officer told Kantipur. It is a more serious matter to pledge even the identity cards of the secretaries for the purpose of assuring foreigners to bring gold. According to section 51 (2) of the Criminal Code, if this offense is confirmed, it can be imprisoned for up to 5 years and fined up to 50,000 rupees. If it is confirmed that the offense was committed while abroad, it can be imprisoned for an additional 3 years. Jitendra made a border identity card to travel to China from the district administration office Humla by keeping a wrong address to smuggle gold.

Ex-Vice President's sons in gold smuggling

Jitendra, who was living in Kathmandu with Duikholi rural municipality of Rolpa as his permanent address, had even made an identity card to cross the border, pretending that he was a resident of Humla Simkot. According to a police official, Section 16 of the Prevention of Corruption Act, 2059 may be attracted against Jitendra, who holds a public position as the personal officer of the Vice President. Those involved in the crime of creating government identity cards by giving false information in violation of the law can be imprisoned for 6 months to one year and fined from 10,000 to 20,000 rupees. Amount of offense if giving false details of educational qualification, name, three generations age, caste, surname, address or citizenship or qualification or any other matter or submitting false certificate related to the purpose of obtaining the position of national servant or remaining in that position or obtaining any status, benefit or facility. Imprisonment from one month to 1 year or fine from 10,000 to 20,000 rupees is mentioned.

Jitendra of Rolpa Duikholi had made an identity card from the Ministry of Home Affairs by showing himself as a resident of Simkot to travel from Hilsa border in Humla to Taklakot in Tibet for gold smuggling. After that, he went to Taklakot and entered into a written agreement with a Chinese merchant to bring gold on loan. For that, it has been revealed that government documents and photos with high-ranking people have been given to the Chinese. Former Vice President Pun's youngest son Dipesh and foreign affairs expert Jeevan Kumar Gurung have been arrested in the gold smuggling case.

Gurung, who was appointed as 'foreign affairs expert' of former Vice President Pun, was arrested in the case of smuggling 14 kg of gold imported from Dubai on November 19. The court released Gurung on a bail of Rs 15 lakh last Sunday. Recently, the fact that Jitendra, the son of former Vice President Pun, was involved in smuggling was revealed, and the police also started further investigation into Jeevan. Jeevan is alleged to be involved in the management of the gold brought in through Jitendra and Dipesh.
