Mentioning the essence of the decision made by the three judges, Ghimire said, 'The then Chief Minister did not take a vote of confidence as per Article 188-2 of the Constitution in the event that a party or person supporting the government formed as per Article 168-5 of the Constitution withdraws their support. In such a situation, the head of the province called for the formation of a new government and it was decided that the writ will be dismissed as it appears that the new government has been formed and the government has received a vote of confidence.

Congress's Kedar Karki filed a writ seeking permission to make him the Chief Minister. Former Chief Minister Kedar Karki also made opposition to Provincial Chief Parshuram Khapung, Provincial Assembly Speaker Amber Bahadur Bista, UML Parliamentary Party leader and Chief Minister Hikmat Karki, Koshi Provincial Assembly members Revathiraman Bhandari, Ganesh Prasad Upreti and Kishore Chandra Dulal.

Province Chief Khapung had appointed Karki as Chief Minister according to Article 5 of Article 168 of the Constitution on May 28. The Chief Minister dismissed Hikmat Karki as the Chief Minister and dismissed the outgoing Chief Minister Karki on the basis of the Parliament's resolution proposal, the withdrawal of support by the UML MPs who had supported him when he was made the Chief Minister, and the vote of confidence.
