The police has submitted a report to the public prosecutor's office in Nawalparasi with the recommendation to prosecute Gita Basnet, a proportional member of the RPP, as the main defendant on the charge of misappropriation of the funds of the cooperative in a private company.

Police's recommendation to prosecute the RPP MP who joined the cooperative's savings company

However, the police did not proceed with the investigation on Ravi Lamichhane, the chairman of the RSVP and the home minister, who was involved in this type of embezzlement. On the contrary, the entire ruling coalition has taken the stance of not proceeding with the investigation saying that he is innocent.

District Police Office East Nawalpur SP Narahari Regmi said that an investigation report was submitted to the public prosecutor's office on Friday, with 12 people, including MP Basnet, as the main defendants in the case of embezzlement of funds of the Kawasoti-based Chhihopay cooperative. "The case was not prosecuted because MP Basnet was a saver, member or director of the cooperative, he was made the main defendant on the charge of embezzlement by taking the funds of the cooperative and investing in the resort," he said.

According to the police, 10 of the 35 defendants are in custody, while the other defendants, including MP Basnet, are absconding. Police has demanded Rs 16 crore 56 lakh 91 thousand 31 rupees.

As it is confirmed that the defendant Gita Basnet has committed an offense under Section 122 of the Cooperative Act 2074, as per the provisions mentioned in the Cooperative Act, the amount equal to the maximum limit of the reference interest rate of the loan shall be calculated as compensation and the amount shall be calculated as compensation. According to sub-section (1) of d, the demand for full punishment has been taken,' said the report submitted by the police to the public prosecutor's office.

It seems that Deputy Prime Minister and Home Minister Lamichhane can also be investigated, prosecuted and filed a case using this section of the Government Act like Basnet. In Gorkha media network operated by Lamichhane and Geetendrababu (GB) Rai, the savings of thousands of common people have been embezzled from Suryadarshan of Pokhara, Supreme of Rupandehi, Swarnalakshmi of Kathmandu and Sahara Sahakari of Chitwan by bringing in 958 million 89 thousand rupees. The police have recommended filing a case against MP Basnet on the charge of misappropriation of savers' funds from three cooperatives in a similar manner.

Like Basnate, when Lamichhane was the managing director with 15 percent shareholding, 803.1 million rupees was embezzled from four cooperatives in Gorkha Media Network. Out of that, Rs 2 crore from Supreme and Rs 1 crore from Suryadarshan were collected in the name of Lamichhane, the evidence shows. After this fact came out, the main opposition party Congress has been disrupting the meeting of the House of Representatives demanding a parliamentary inquiry committee.

Although a task force was formed under the coordination of Law Minister Padam Giri to reach an agreement on the jurisdiction of the investigation committee, the members of the pro-government task force are adamant that the names of cooperatives such as Suryadarshan, Supreme, Swarnalakshmi, Sahara and others should not be mentioned. The Congress, while Lamichhane is the managing director, is of the position that the name of the person and the company should be kept so that the misappropriation of the cooperative's funds will be investigated.

RPP has also demanded an investigation on Lamichhane. Along with an independent investigation into the co-operative savings embezzlement case involving party MP Basnet, the demand for inquiry, investigation and prosecution of other persons involved in embezzlement of a similar nature has also been put forward.

The RPP Central Performance Committee meeting held last May 18 to 20 demanded a fair investigation on Basnet from the responsible government agencies and said that the government agencies should treat others like him in the same way. This means that since Deputy Prime Minister and Home Minister Ravi Lamichhane is also involved in misappropriation of cooperative savings like Basnet, RPP Party Chairman Rajendra Lingden said that he should also be investigated.

'After the issue of misappropriation of co-operative funds to the company came out, we have instructed our MP to assist in the investigation process of this matter. We have asked the police to conduct a fair investigation and to take action against others involved in this kind of abuse,' he said, 'This means that Home Minister Ravi Lamichhane also had to be investigated, investigated and acted upon.' MP Basnet has been made the main defendant. The police investigation showed that a group including Yogendra Pandey took Rs 165.58 million unsecured from Sunrise in Chitwan, Chhihope in East Nawalparasi (Nawalpur) and Krishnasar Resort operated by MP Basnet from Namaste Cooperative in Bardia. The investigation of the police and cooperative registrar office has identified Yogendra Pandey, the current manager of the cooperative, as the main planner of the money embezzlement. He was the chairman and manager of the cooperative for seven years. The police have also listed the members of the committee who took loans and disbursed loans on unsecured and low collateral. In the

report, MP Basnet colluded with the employees of the cooperative and used the property of the cooperative to match his personal transactions, to use the land, buildings, structures, decorations, etc. of the Krishnasar resort he operated, to use it for election expenses and to acquire private property. It is mentioned that it was taken.

Section 122 of the Cooperative Act-2074 provides that those who do such an act are considered to have committed an offence. 'Anyone shall cause or not do any work, solicit or cause, receive or give any amount of money, receive or give any goods, goods or services for free or at a low price, receive or give donations, donations, gifts or donations, with the intention of causing harm to the cooperative organization. It is mentioned in the act that it is considered an offense to prepare or cause a false document, to translate or cause it, or to do or cause any act with malice that causes illegal gain or loss.

Those who have committed such an offense are subject to action as per Section 124 of Subsection (1) d of the Act. Imprisonment for up to one year in case of failure up to ten lakh rupees, imprisonment for two years to three years in case of failure up to fifty lakh rupees in excess of ten lakh rupees, imprisonment for three years to four years in case of failure in excess of fifty lakh rupees up to one crore rupees, imprisonment for four years in case of failure in excess of one crore rupees up to ten crore rupees. Imprisonment for a year to 6 years, imprisonment for 6 years to 8 years for embezzlement of more than 10 million rupees to 1 billion rupees, and imprisonment for 8 to 10 years for embezzlement of more than 1 billion rupees.

MP Basnet is recommended to be prosecuted according to this law, if the investigation process is initiated against Deputy Prime Minister and Home Minister Lamichhane, he may be sentenced to imprisonment for at least 4 years to ten years.
