The Supreme Court has ordered to cancel the suspension of Nepali Congress House of Representatives MP Tek Bahadur Gurung. The bench of Justices Manoj Kumar Sharma and Vinod Sharma on Friday ordered to revoke the suspension of Gurung, who was elected as a member of the House of Representatives from Manang.
In the order, it is said, 'The notice published by the Federal Parliament Secretariat on 2079/9/12 stating that the petitioner has been automatically suspended since 2079/9/08 and the related decision of the Abuse of Authority Investigation Commission on 2079/9/8 and correspondence based on that Articles 20 (5), 87, 246 (3) of the Constitution of Nepal, Section 9 of the Federal Parliament Secretariat Act, 2064, Rule 248 (3), (4) of the House of Representatives, 2079 were found to be flawed in terms of application and interpretation.
The notice issued by the Federal Parliament Secretariat on December 12, 2079 and the related decision of the Abuse of Authority Investigation Commission on December 8, 2079 and the order to send the correspondence based on the same have been annulled.
Gurung, a member of the House of Representatives, was accused of corruption when he was the Minister of State for Labor and Employment in the government led by the then Prime Minister Sushil Koirala, when he leased the land of the fun park in Kathmandu Bhrikutimandap.
