Cancellation of contract to lease 29 ropani land of Bal Mandir to Brihaspati Vidya Sadan

For that, Brihaspati had made an agreement to take 600,000 votes from the school annually. In writing, that amount is shown as 1 lakh.

Also, with the plan of perpetual occupation, a lease agreement was signed so that the lease period would be 90 years from the beginning and maintained until 2131, and the property of the Bal Mandir would be owned by a private company . The current president Neupane said that this lease agreement was canceled as it was seen as detrimental to the children's organization and the country.

This is how the land-killing game happened.

Children's organization first entered into an agreement with Brihaspati on 26 Baisakh 2049 to lease 9 ropani land and house/floor in the name of the organization until 10th of January 2053. The annual rental rate of which was 42 lakh 16 thousand 6 hundred and 8 rupees. There was also a clause in the agreement to give a 20 percent discount on the rental amount if paid in advance. According to the agreement, the details of the rent paid by Brihaspati are not visible in the organization's records, the authority source said. However, the children's organization extended the contract by 5 years.

Bal Sangathan seems to have given an additional 5 ropani 2 annas of land to Brihaspati through a supplementary agreement with an increase of 10 percent on the previously fixed annual rent on 8th June 2058. While Brihaspati sent a letter to Bal Sangathan on 6th January 2057 asking for only 2 more acres of land. The supplementary agreement was signed by the then director Rajeshwar Niraula on behalf of the organization. Authority sources said that an investigation is being conducted into whether the officials of the children's organization may have made opaque transactions with Brihaspati for giving more land than requested.

At that time, the annual rent of the land that Brihaspati was enjoying was 30 lakh rupees. Brihaspati proposed to Bal Sangathan on July 21, 2059 to take additional 13 ropani land with a lease term of 30 years and a monthly rental rate of Rs 480,000. The Central Committee meeting of the Children's Organization held on July 30 authorized the General Secretary Ramkaji Kone to enter into an agreement to lease the land of 13 ropani 12 annas 1 paisa under lot number 760 to Brihaspati for a period of 2088. This time also it was decided that Jupiter would get 12 annas and 1 paisa more land than asked for. According to Brihaspati's proposal, the agreement was authorized to increase the rent at the rate of 5 percent in 2 years, not to increase the rent in the first and last 5 years, and increase the property of 50 million within 15 years. Based on that, on August 11, 2059, an agreement was signed between the organization and Jupiter for 30 years. The agreement is said to be effective from 1st May 2059. The agreement was signed by the then vice president of the organization Yogendra Bahadur Shahi, general secretary Ramkaji Kone and head of administration and procurement branch Tikamani Neupane.

After that, a dispute started between the owners of the organization saying that they rented the land cheaply. After receiving a complaint in the authority, the investigation started. The authority directed to review the rent. But on behalf of Brihaspati Chief Administrator Murarinidi Tiwari sent a letter on 7th November 2066 saying that the rent could not be revised. Then the central working committee meeting of the Children's Organization decided to terminate the lease agreement with Brihaspati for 13 ropani 12 annas 1 paisa land on 14th December 2066. The general secretary of the organization, Krishna Shankar Sah, informed Brihaspati about the decision of the meeting on 30th January 2066 to be implemented from the same day.

On 28th January 2016, a resource management committee meeting of the children's organization was held under the coordination of Subas Kumar Pokharel, consisting of Rajeshwar Niraula, Santosh Bhattarai, Krishnashankar Sah and Manohar Gopal Shrestha. The meeting decided to pass the registration and give the land returned from Brihaspati to Tarun Nirman Seva. The owner of Tarun was Manoj Kumar Mishra. Authority for land registration was given to Shah. The consent of the government was not obtained when Tarun was given the registration pass on 13 Jan 2066. Although the agreement was made, Jupiter did not leave the land. After the

agreement, it has been proven that the then president Vaidya also took 75 lakh rupees from Tarun. Vaidya has also admitted to the commission of inquiry led by ex-judge Bhattarai that she took the money to 'run the organization's expenses'. While that amount has not been deposited in the fund of the organization. On the other hand, Brihaspati approached the Supreme Court saying that the contract for the land that was being occupied had been unilaterally terminated. Both parties reconciled in the court on 21st June 2072 and it was decided to give the land to Brihaspati at a cheap price.

It was agreed against the law to extend the period of 43 years from 2088 to the expiry date of the previous agreement, not to extend the last 8 years, during this period, Jupiter will increase the assets of 52 crores, can give land lien and sublease and within 6 months, the children's organization will build a 2-room building. Under the guise of the same agreement, Jupiter killed the land until 2131 through supplementary agreement on July 3, 2072. In the supplementary agreement, there is a provision that the bank can do business with the lien of the government land. The commission of inquiry called it a bad deal.

It is mentioned in the letter sent to the authority and before that, that Bank of Kathmandu took a renewable loan of 133 million rupees for 1 year on 26 August 2075 and took a renewable loan of 13 million rupees for 1 year. Lien property is sometimes treated as a bank mortgage. If the loan is not repaid on time, the bank can auction it. It is said that the authority is also investigating the 'illegal agreement' of the children's organization to approve the loan by mortgaging the structures built on government land.

Brihaspatia's operations head Badal claimed that there is no need to dispute the issue of the right of occupancy after settling in the court. "Bhrikutimandap's land is leased for normal money, we have taken a lease with the children's organization paying an annual rent of about 1 crore rupees," he said.

The palace built in the name of Rana Prime Minister Bhimshamsher's wife Sita was acquired on November 17, 2021 and placed under the ownership of the Central Child Welfare Committee for the welfare and maintenance of underprivileged children. During the Panchayat period, the then Rajdarbar protected the lands in the name of children's temples and children's organizations in different districts of the country. 'Sita Bhawan' which was called 'Tangal Darbar' during Rana period is now known as Bal Mandir. According to the records of the Ministry of Home Affairs, 119 ropani 12 annas 3 paisa land of Sita Bhavan was acquired and kept in the name of children's organization.

Out of that, 5 ropani land has been allotted for the Central Deaf Secondary School. Similarly, the investigation revealed that 2 plants are being used for vehicle parking by the authority. After the expansion of the pond in the structure of the Metropolitan Police Circle Kamalpokhari, the circle was transferred from there to the 5 ropani area of ​​the Bal Mandir complex. More than 50 ropani land has been given usufruct to Nepal Lalitkala Pragya Foundation. The office of the institute is inside. The 4 ropani 2 annas land under Lot No. 760 is being used free of cost by the Nutrition Program run by the Ministry of Education. Apart from that 51 rupees 3 annas 13 paisa are in the name of children's organizations. Out of that 29 ropani 4 annas land is being used by Brihaspati Vidya Sadan.
