A writ petition has been registered in the Supreme Court regarding the issue of ownership of Hetaunda Hospital as there is a dispute between the political parties whether to keep it under the Madan Bhandari Institute of Health Sciences or not.

Advocate Keshav Prasad Gautam has filed a writ petition regarding the ownership of the hospital, making 10 entities including the federal government defendants.

Advocate Gautam has made the director of the institute a respondent in the writ registered against the registrar of the Madan Bhandari Institute of Health Sciences. The Supreme Court has fixed August 26 for the preliminary hearing on the writ petition.

It is mentioned in the writ petition that a law has been made to give the government property to a certain organization and the moveable property of Hetaunda Hospital has been seized. Under Article 133 (2) (3) (4) of the Constitution of Nepal 2072, advocate Gautam has requested to cancel the law of the province which is in conflict with the constitution and the federal law.

In the writ filed by advocate Gautam, it has been said that Hetaunda Hospital, which was operated by the then government in 2016, cannot be owned by the state government against the constitution and laws. It is mentioned in the writ that the constitution and federal laws do not provide the province with the right to make laws, rules, regulations, and make government property foundations for Hetaunda Hospital and other hospitals of the province to be under the foundation.

It has been demanded in a writ petition to revoke the Madan Bhandari Institute of Health Sciences Act 2076, which was created by the Wagmati Provincial Assembly to obstruct the provision of health-related services to Hetaunda Hospital. Advocate Gautam has mentioned in the writ petition that various sections/subsections of the Madan Bhandari Institute of Health Sciences Act 2076 are inconsistent with the Constitution.

It has been requested in the writ petition to order the sending of the various regulations, decisions, orders, instructions, correspondences made by the province in conflict with the constitution, federal laws, so that they cannot be implemented.
