  • Demand of authority affiliated trade union to connect the line only after settlement of accounts

The Electricity Regulatory Commission has instructed the Nepal Electricity Authority to connect the cut off electricity to the dedicated and trunkline arrears, stating that there is a legal provision that the electricity supply of consumers cannot be disconnected before the dispute is resolved. The commission meeting on Sunday gave written instructions to the authority to connect electricity to 6 cut off industries.

According to the commission, the electricity consumers (industrialists) had submitted the application on Friday itself. Commission Chairman Ram Prasad Dhital said that the Authority has been instructed to implement the same application according to the Directive on Protection of Interests of Electricity Consumers, 080. "It's not our new decision, it's an instruction to implement as per the guidelines already made," he said. After that, we have instructed to study the facts and submit them to the commission within one month.' After providing electricity to the community organization that distributes electricity, if there is no satisfactory action, a complaint can be submitted to the distribution or consumer service office in writing or through electronic technology,' said in sub-section 1 of section 13 of the directive, 080.

According to sub-section 10 of section 13 of the directive, the commission has instructed to connect the electricity, saying that there is a legal provision that the electricity supply of the consumer cannot be disconnected before the complaint is resolved. "Prior to the resolution of the complaint according to sub-section 1, the person who has received the distribution permit or the community organization that distributes electricity shall not be allowed to disconnect the electricity supply of the concerned consumer," it is mentioned in sub-section 10 of section 13 of the directive. "The application was received on Friday, we discussed it from Sunday morning and gave instructions to implement it according to the guidelines," Dhital said. Although the commission said that it has decided and given written instructions, the authority has said that it has not received it.

Last Friday under the leadership of Prime Minister KP Sharma Oli, a discussion was also held between Energy Minister Deepak Khadka, Executive Director of the Authority Kulman Ghising and industrialists Pashupati Murarka and Amit More. At that time, Prime Minister Oli gave instructions to connect electricity immediately. In the same discussion, he said that the decision of the board of directors of the authority is necessary to connect the electricity. Soon after, the board meeting of the authority was also held. Even at that time, the member of the board of directors of the authority said that electricity can be connected only after receiving a written letter from the government and after the board meeting of the authority has made a decision.

After the authority demanded a continuous written letter, the Electricity Regulatory Commission on Sunday gave written instructions based on the guidelines. In the case of trunk line, in the case of 6 hours of load shedding, 20 hours of continuous electricity was used and in the case of dedicated line, the condition was to provide 24 hours of continuous electricity. The commission headed by former judge Girishchandra Lal has recommended that additional funds should be collected from the industry by proving the fulfillment of these conditions. The authority says that it is also directing the industrialists to pay the arrears as per the recommendations of the commission. Based on the report, the industrialists are saying that they are trying to collect the arrears without giving proof of the bill.

The Board of Directors of the Authority also decided to implement the decision of the Ministry of Energy to implement the Commission's report. In order to implement the same decision, the authority had sent a letter to 61 industries on June 10 asking them to pay the dues within 15 days. The total amount owed by the industrialist to the authority is 6.6 billion rupees. But since 60 days have been cut off to pay the electricity bill, the authority has asked the industry to pay by adding 25 percent additional fee.

On June 25, the authority started cutting off the electricity as the time expired. So far, electricity has been cut in Arghakhanchi Cement, Reliance Spinning Mills, Ghorahi Cement, Jagdamba Spinning, Jagdamba Steel, Hulas Steel. According to the members of the board of directors, the authority worked according to the electricity tariff collection regulations during the implementation of the commission's report.

"During the implementation of the government's decision, electricity has been cut, so a written decision must come from the government," said the member. The board does not decide whether to cut the electricity or not.' Meanwhile, regarding the implementation of the written instructions of the Electricity Regulatory Commission, they say that it should be discussed whether the members are a regulatory commission bigger than the Council of Ministers or the government.
