MPs have approached the Supreme Court with a writ petition against the appointment process of the Chief Minister of Madhesh Province.

The parties have approached the Supreme Court against the government formed in accordance with Article 168, Clause 3 of the Constitution. The writ is signed by 74 provincial MPs from Madhesh.

Nepali Congress Parliamentary Party Leader Krishna Prasad Yadav, JSP Nepal Parliamentary Party Leader Saroj Kumar Yadav, Maoist Center Parliamentary Party Deputy Leader Yubaraj Bhattarai, LOSPA Parliamentary Party Leader Jayalun Rain and other leaders have approached the Supreme Court.

There are 107 MPs in Madhesh Province. The number of 54 MPs is the majority to form the government. UML has 25 including the Speaker, Congress 22, JSP 19, Janmat 13, Maoist 9, LOSPA 9, CPN (S) 7, Federal Socialist Party, RPP and Civil Liberties Party have 1 MP each. Among them, UML MP Dipendra Thakur, JSP MP Saroj Singh Kushwaha, and LOSPA MP Abhiram Sharma have been suspended. The current number of members in the Madhesh Provincial Assembly is 104.

Province Chief Sumitra Bhandari administered the oath of office to UML leader Saroj Yadav as the Chief Minister early on Monday at a hotel in Bardibas. It is being criticized as politically, constitutionally and morally wrong.
