It has been 18 years since the Gaur massacre in which 27 Maoist activists were killed. At the center of the brutal incident, which appears to be a battle on the battlefield, 113 people including the then Madhesi Janadhikhar Forum leader and former Deputy Prime Minister Upendra Yadav, former Assembly Speaker Baban Singh, and former Madhesh State Assembly MP Babulal Shah were involved. The duty of the Maoist to be involved in the incident is anonymous even though a complaint has been registered.

Naming the public meeting, there was a clash on the afternoon of March 7, 2063 when the Maoists and the forum were going to hold a program at the same place at the same time. During the clashes, the Maoists have accused the forum workers of brutally killing those who fled for their lives wherever they found them by hitting them with sticks, bullets and sticks.

There was a clash before the meeting could be held on both sides. The forum was calling its leaders-activists on the stage to start the meeting . Maoist 'YCL' workers were going around Gaur Bazar. After a while, YCL entered the field . Seeing that the stage towards them was destroyed, the Maoists presented themselves in an aggressive manner and the situation of clashes was created. 

There was a clash from both sides and there was also a shootout. 27 Maoist activists including 5 women were killed in the Gaur incident caused by their insistence on holding a program at the same place. It is mentioned in the complaint registered with the police that 42 people were injured in the incident.

The body of the person who died in the incident was found in 7 places outside Gaur municipality. The police prepared 7 files accordingly. The district police registered the case of duty against 113 people for being involved in the massacre on 28 Baisakh 2064 i.e. 51 days later. The file is still anonymous in the drawer of the district police.

A complaint has been registered against many leaders of Madhesh party, including Kishori Yadav, ex-member of Rautahat-3 and Ajay Gupta, ex-head of Gaur municipality, for being involved in the murder. District Police Chief SP Dilip Ghimire tried to avoid saying that he had not yet seen the missile of the Gaur incident.

It doesn't seem that the police registered a case and proceeded with the process at that time. A police officer said that usually after the registration of a case of any heinous crime, the arrest warrant should be obtained and the accused should be searched and investigated immediately. Police Inspector Umashankar Prasad of the case division of the District Police also told that 7 missiles of the Gaur incident case have been kept. After 9 months of the incident, the government compensated the deceased family at the rate of 1 million. The Madhesh activists have been objecting that the case has been registered to confirm the involvement in the incident and to seek revenge on those who are not. 

UML leader Ajay Gupta said that he was not going to the public meeting and was resting at home at the time of the incident. He said, "I filed a complaint with the name of the one who got the Riseb Sandhan," he said, "Someone confirm that I am involved in the incident." I have objection to the naming being prejudiced.' Gupta is also a Pramakh of Purvanagara Gaur.

The main leadership of the parties involved in the clash at that time are now respectively Maoist and Janata Samajwadi Party in Nepal . Even though the police said that the cases were registered as absconders, they have become ministers, MPs and mayors. 

According to the on-site study report prepared by the human rights organization INSEC after the Gaur incident, "all the deceased had deep injuries on their heads". They have been pelted with bamboo sticks, stones and bricks and have also been set on fire.'

The bodies of Saraswati Upreti, Rekha Pariyar and a girl from Chandranigahpur were found in the local Boudhidevi temple premises in a state of blood sacrifice. The family of deceased Rekha's father Ram Bahadur expressed grief saying that the police did not dare to investigate and arrest the culprits in the heinous crime. Prabhu Sah, Chairman of Amjanata Party and Member of Parliament, said that he was surprised to see that the police could not proceed with the investigation to confirm the involvement of the incident.

'The report of the investigation committee formed during the incident has also arrived . So far, the government has not taken action against the main planners and those involved in the murder,' he said, 'Why did you stop the investigation and action against the culprits?' MP Sah has been demanding to open the file of Gaur incident in the House of Representatives and start an investigation and take action against those involved.

The then Home Minister Krishna Sitaula, who came to the scene at that time, said that he would investigate and take action against the culprits. The next day, the ministry issued a statement that the government is committed to investigate this very large and violent criminal incident and take action against the culprits.

Maoist Chairman Pushpa Kamal Dahal also issued a statement on March 8, 2063 and demanded to ban the forum. On the same March 10  The then district president of the forum, Amar Rai Yadav, issued a statement and alleged that the Gaur incident took place at the direct instigation of Maoist chairman Dahal.  The then president of

forum Upendra Yadav also issued a statement a week later and said that Dahad and the then Home Minister Sitaula should take responsibility for the Gaur incident.

This is how the incident happened. Even when the local administration requested not to hold the meeting at the same place, both the parties did not agree. The forum had built a platform in the south corner of the ground and the Maoists in the north corner the previous day.  Maoist was in favor of not allowing the forum to hold a meeting under any circumstances, while the forum was on the stand of leaving the meeting. The previous night, Maoist workers called from Makwanpur, Sindhuli, Dang, Bajura, Bara, Parsa, Siraha, Chitwan, Kavre, Rukum, Saptari were assigned to the meeting. They came with small arms . 
forum invited the chief guest leader Upendra Yadav . The Maoist then District Incharge Prabhu Sah . But both leaders did not come to the stage. The YCL worker had stayed at Dharamshala for Ramzan in Gaur the previous night. As most of them came from outside, they did not know the geography of Gaur . That is why the Maoists suffered more damage. 

An hour before the start of the meeting, YCL toured the city . Their group was around one hundred. At that time, the platform of the Maoists built in the field was vandalized and set on fire.  The

forum was calling its leaders and workers to the stage to start the meeting . At the same time, YCL's group entered the field . After seeing that the stage towards them was destroyed, when they performed aggressively, a situation of clashes was created. 

There was also shooting from both sides . Only 10 policemen were stationed in the assembly under the command of Sai from the district police . They also ran away to save their lives when the double firing started. The field became a battlefield in an instant. While the YCLs were running away, Gowda was killed by the forum workers who were waiting with a baton. Then put it in the drain and cover it with a cement shield from above. 

Nepal Red Cross and the police took out most of the bodies from the drain. Forum activists also tried to attack the injured who were immediately brought to Gaur Hospital. The district police also imposed a curfew after the clash continued till late evening. At the time of the incident, the then SP Ramkumar Khanal, who was working in Rautahat, did not budge when he requested the leaders of both parties to stop the meeting.  The day after the

incident, then Congress Home Minister Krishna Sitaula, Maoist's then Communications Minister Krishna Bahadur Mahara came to Rautahat . Various rights organizations monitored the scene. Yuvraj Bhattarai, an eyewitness to the incident and the MP of Madhesh Province, complained that it is unfortunate that no action has been taken against those who killed in the name of clashes.

Upendra Yadav, president of Janata Samajwadi Party and now president of Janata Samajwadi Party, claims that the then president of Madhesi Janadhikhar Forum clashed when locals resisted against the Maoists in Gaur incident. He has also been denying his involvement in the incident .  When the

incident started to be investigated impartially, the government immediately formed a high-level investigation team under the coordination of the then judge of the Appellate Court, Patan, Hari Prasad Ghimire.

The government team included then Judge Anant Dumre of District Court Jumla, Justice Tika Bahadur Hamal, then Deputy Inspector General of Police Ramesh Chand and then Chief of National Vigilance Center Ram Sarbar Dobe. The report of this committee has not been made public yet.

Since 2063, 24 District Police Chief SPs have come to Rautahat. But no one has been able to open the file of Gaur murder case . DIG Dinesh Kumar Acharya, the spokesperson of Nepal Police, said that since it is a very old incident, it is necessary to understand it. 

District Attorney of Rautahat, Mohammad Munna, said that cases of duty killing should be taken to the court within 20 years or a decision should be made to proceed/not proceed. The police said that they can arrest him now and continue the investigation.
