Election code of conduct violation: Commission asks for 88 clarifications

The Election Commission has asked for 88  clarifications on charges of violating the election code of conduct. The Election Commission has stated that it has received replies to 57 of the clarifications asked for by the Commission.

According to spokesperson Narayan Prasad Bhattarai, out of 254  complaints received by the Central Code of Conduct Monitoring Committee, including information received through emails, personal registrations and media, clarifications have been asked for 88 complaints, and 57 have been replied to. The Commission has asked for clarifications from 4 political parties. It has asked for clarifications from 33 candidates. In addition, the Election Commission has stated that 51 clarifications have been asked from government/academic persons. According to the Election Commission, there are 8 in Koshi Province, 40 in Bagmati Province, 6 in Gandaki Province, 7 in Lumbini Province, 4 in Karnali Province and 4 in Sudurpaschim Province.

The Election Commission has fined some candidates after the clarifications were answered. The Commission has decided to fine Shakti Bahadur Basnet, the candidate of Jajarkot Constituency No. 1 of the Nepal Communist Party, Rs. 25,000 as per Section 23 of the Election Commission Act, 2073, for violating the election code of conduct. A complaint was filed against him for distributing money during election campaigning. 

Similarly, in Rupandehi Constituency No. 2, Nepal Janasewa Party candidate Dr. Kamal Bhusal (Nicholas Bhusal) has been fined Rs. 25,000 for using Gen-G shoes without permission. The Shram Sanskriti Party led by Hark Sampang has also been fined Rs. 25,000 for violating the code of conduct. Khagendra Sunar, the candidate of the SWAPA from Bake, and Januka Pathak (Shobha), the candidate of the Nepal Janasewa Party from Bhaktapur 2, have been warned. 

A total of 1,076 complaints were filed with the District Code of Conduct Approval Committee and Monitoring Officer. Of these, 1,061 (99%) have been resolved, the commission said. 

Provincially, Lumbini Province has received the highest number of complaints with 244, while Sudurpaschim Province has received the lowest number of complaints with 96. Of the complaints received, 97 (9%) were received in writing and 979 (91%) were received through telephone, SMS and other sources. Among the complaints received, the most common were using banners and flags larger than the prescribed size, misusing social media, creating noise pollution by playing DJ microphones, teachers and employees and local public representatives campaigning, hanging flags in public places and vehicles, and using vehicles without permission.
