The then Speaker Devraj Ghimire has stated that there is no legal provision to directly order the Prime Minister, Home Minister or security agencies to stop the firing.

Ghimire has also suggested to the Gauri Bahadur Karki-led inquiry commission that a single command system based on a threat analysis and a clear protocol should be used to deploy the necessary number of security personnel for the security of the federal parliament building to prevent such incidents from recurring in the future.

‘I am of the opinion that issues such as the principle of use of force, the need and justification for firing are matters that should be evaluated by the relevant experts and agencies based on security policy, law and the prevailing situation. This issue does not fall within the direct jurisdiction of the Speaker,’ he said in the statement. ‘Apart from raising questions about the principle and sequence of use of force, I assess that the security personnel have made every effort to protect state property, the parliament building and the people and property there even in risky situations.’

He stated in his statement that the security of the Federal Parliament building is the responsibility of the security agencies under the Ministry of Home Affairs and that the Speaker has no legal authority.  However, since the responsibility for such structural reforms and security infrastructure falls under the executive and the Ministry of Home Affairs, I had not taken any special initiative as Speaker before,” Ghimire said in the statement. “I received information about the shooting on the Parliament building premises on Bhadra 23 in the afternoon. After that, I had instructed the General Secretary of the Parliament Secretariat to coordinate with the security agencies. There are no reports of major casualties in the vandalism and arson that took place in the Parliament building on Bhadra 24, apart from some minor injuries.”
