The Kaski District Court has allowed Ravi Lamichhane, who was arrested in the investigation of crimes related to cooperative fraud, organized crime and money laundering, to be detained for another 13 days.
The police have given 13 days to detain ex-director of Gorkha Media ex-DIG Chabilal Joshi, ex-employee of Suryadarshan Sahakari Leela Pachai and owner of Nature Herbs International Ram Bahadur Khanal for investigation in the same crime.
Lamichhane, who is also a former home minister, was arrested on November 2 from the central office of RSVP and brought to Kaski. Lamichhane was initially investigated for 6 days, then 7 days and 10 days later. Joshi was arrested on October 6, followed by October 13 and Khanal on October 9. In case of money laundering, the police can investigate by detaining the accused for a maximum of 90 days.
On behalf of the government, District Attorney Kamala Kafle, Assistant District Attorneys Bipinraj Tiwari and Shantidevi Sharma, Yuvraj Parajuli, legal practitioner for cooperative victims, argued on behalf of the government in the debate held in Judge Navraj Dahal's courtroom on Sunday. Five persons, including senior advocate Sushil Pant, argued on behalf of the defendants including Lamichhane. Prosecutor Krishna Prasad Jaisi and defendant Lamichhane also spoke on behalf of the victims.
The victim, Jaisi, informed the court that he had applied to the National Human Rights Commission after feeling unsafe. He said that the administration had to issue an injunction when the RSVP protested to pressurize the release of the accused, who were in custody for investigation, and the victim felt unsafe. His argument was that if Lamichhane is excluded from the investigation, the game of changing the government will start again, and there is a possibility that he will come back to power and affect the investigation process itself. He said no to the issue of supplementary notification even when he was the Home Minister. He made the attorney general's office, the chief of police and the prime minister himself to say that he is innocent," he said.
Lamichhane informed that he had already spoken in Parliament regarding the return of savers' savings and said, "This is a matter that should not come up in the judicial process." He also argued that Jaherwala was not the real victim and that he was being personally reprimanded. His lawyer insisted that there was no evidence to extend the time limit to keep Lamichhane in custody.
Judge Dahal said that Zaherwala does not feel the legal rule when she feels insecure. He insisted that the money of the savers should be returned. Mr. (Judge) also told us that you should also search the assets of the accused, that you should search for the investigating agency,' said Jaisi to Kantipur. . We also learned a lesson from that. It seemed that the judge paid more attention to returning the savers' money in the courtroom on Sunday.'
Lawyer Renuka Sitaula, who argued on behalf of Lamichhane, said that she would respect the court's decision even if the deadline was extended without a basis. Raviji is not a person who runs away. It is not possible to understand why the deadline is being extended," she told Kantipur.
