Less than a month after becoming Home Minister, Bamdev Gautam had removed Inspector General of Police Achyut Krishna Kharel and appointed an Inspector General of Police of his choice. Home Minister Bamdev had removed Kharel from the position of Inspector General on Chaitra 21, 2053 BS and transferred him to the post of Chief of the Investigation Department.
This was the first case of an IGP being transferred to a position where there was no vacancy. Bamdev had removed Kharel and made the then Additional Inspector General of Police Dhruv Bahadur Pradhan the Inspector General of Police. Kharel was removed on the 36th day of his appointment as IGP. Govinda Thapa, the head of the Investigation Department, was transferred to the Special Police. Bamdev's decision was widely opposed.
Kharel had filed a writ petition in the Supreme Court demanding his reinstatement, claiming that he had been illegally removed from the post of IGP. But even after 8 months of filing the writ petition, the court had not yet delivered its decision. Hearings were being held but no decisions were being made. Bamdev was accused of using the state machinery to defeat the opposition in the local elections held after he became the Home Minister. In 2053 Falgun, when Lokendra Bahadur Chand was the Prime Minister and Bamdev was the Home Minister, Kharel was removed from the post of IGP and transferred elsewhere. But in 2054 Asoj, the Chand government collapsed and Surya Bahadur Thapa became the Prime Minister with the support of the Nepali Congress. The Thapa cabinet had kept Kharel as the IGP and appointed Pradhan as the Prime Minister's special advisor. The cabinet had also kept Govinda as the Chief Officer of the former Investigation Department. Kharel and Govinda were reinstated to their previous positions, citing issues such as the fact that the Public Service Commission was not consulted when appointing special service officers to the civil service, that the decision to abruptly remove Kharel and appoint him as the Chief Officer of Special Services without completing the period prescribed by law was not legal, and that the government's decision had created confusion in the police.
After the government's decision, Kharel had resumed his post at the Police Headquarters on 26 Mangsir 2011 and said that the police organization should not develop a tendency to serve its interests. He had argued that after starting his service in the police organization, he should be allowed to retire within the same organization. 'This is the natural right of the police,' he had said. He had put forward the idea of creating a police welfare plan targeting low-level police personnel in the organization.
Kharel's case not resolved
Kharel's case, which had filed a writ petition in the Supreme Court alleging that he was illegally removed from the IGP position, was limited to hearing for months. Government sources had said that the government had returned Kharel to the IGP position after the Supreme Court delayed its decision. After his return to the IGP position, a kind of dilemma had arisen as to what would happen to the subject of the case.
Although the government had decided to send IGP Kharel to his previous post, the Supreme Court had not been formally informed. Therefore, the way for a full bench hearing was not closed. The Supreme Court had ordered the Attorney General's Office to appear with the government's decision and documents. The source had said that the Supreme Court would decide whether to proceed with Kharel's case after submitting the government documents.
