It is said that the government distributed land titles for squatters in the Rapti area of Nawalparasi for the first time in 2013. After that, after 2021, a rehabilitation company was opened in the Terai Madhesh and a program was run for squatters with the support of the Israeli government. Experts at the time say that there was talk in the panchayat that non-squatters received more land than squatters.
After the multi-party system, a forest conservation task force was formed in 2047 under the coordination of Dron Prasad Acharya. The task force suggested that forest encroachment would spread if the squatter problem was not resolved. In 2047 Chaitra, a squatter problem resolution committee was formed under the chairmanship of Achyutraj Regmi, the interim government's Minister for Housing and Physical Planning. But it has not been seen to have done much work.
After the Congress majority government was formed in 048, a commission was formed on 9 Mangsir 048 under the leadership of Housing and Physical Planning Minister Bal Bahadur Rai, including representatives of the main opposition parties. The commission, which included political leaders, could not work effectively. When party leaders and workers declared themselves as squatters and started demanding land, the commission also said that it could not work. If we are to leave aside the work done by the government in favor of the squatters during the Panchayat period, the debate about the squatter problem that is going on now, we have to go back three decades, i.e. to the Shailaja Commission of 049. Since then, the commission seems to have been working to take records of squatters and distribute land. It seems that the government has started efforts to solve the squatter problem after 046. But the current chaos can be said to be the result of not performing the work honestly and making the problem more partisan. When the commission was formed under the chairmanship of Congress leader Shailaja Acharya, the Congress had a majority government under the leadership of Girija Prasad Koirala. The records of squatters were prepared during Shailaja's two-year tenure. According to the Shailaja Commission's data, the initial identification of squatters appears to be more than 250,000. The commission had finally identified 54,170 people as squatters. Of these, it is said that temporary land titles were distributed to 10,278 people.
Rishiraj Lumsali was made the chairman of the Sukumvasi Commission during the nine-month rule of the UML-led government formed in 2051. He had identified 75,000 squatters during his tenure. It was said that he had distributed land extensively at that time.
At that time, Lumsali seems to have distributed land titles of about 23,000 bighas to 58,000 families. After the UML government collapsed in 2052, he also resigned. In 2052, Land Reforms Minister Buddhiman Tamang himself led the decision to solve the problem of squatters. After that, Chanda Shah led the commission in 2054.
After Surya Bahadur Thapa became the Prime Minister, the commission chairperson Chanda canceled the irregularities that had occurred during the land distribution in the past in 2054. Based on her decision, 54 ropanis of land near Pokhara Fewatal were returned. At the same time, the Commission for the Investigation of Abuse of Authority had started an investigation into irregularities in the land distributed in the names of 1,148 people in Sindhu.
Chairwoman Shah said that at that time, a single person went to wherever there were squatters and registered their names. She said that even those who have houses and bighas of land in the city have registered land in the name of squatters. She informed that 7,000 land titles have been prepared to give land to squatters.
On November 21, 2017, Minister for Land Reforms Prakash Chandra Lohani had said in a press conference that although the Sukumvasi Commission was formed, the work could not be done as intended. At that time, Prime Minister Thapa had said about the squatters, "Land will be registered on the basis of on-site evidence of the place where the squatters are living without affecting the perimeter and environment of urban development."
Minister for Land Reforms Lohani had informed that land titles would be given to the squatters based on the Prime Minister's assurance. He had warned through a press conference that government-owned land should not be encroached upon and that legal action would be taken if anyone tried to do so.
The government had informed that the number of squatters living in forests, rivers, open spaces, pastures and other lands was 181,600 as of Mangsir 2011. The Thapa government had announced the formation of squatter problem resolution commissions in 50 districts. The government said that the main problem was in the Terai and inner Madhesh.
A policy was made to form a special committee to bring impartiality and simplicity to the committee to be formed in the districts and deploy mobile teams from the center. The news prepared on the work done from 2047 to 208 and future plans to solve the squatter problem was published by Kantipur Daily on Mangsir 2011 under the title ‘Action will be taken against squatters who encroach on government land’.
Even if we count only the time after the achievement of democracy, three and a half decades have passed since the attempts to solve the squatter problem have been made. During this period, from Dron Prasad formed in 047 to Keshav Niraula formed in 078, 19 commissions have been formed.
Recently, the National Land Commission was formed to cover not only squatters, but also landless Dalits and unorganized settlers. According to Keshav Niraula, former chairman of the commission, after the commission was formed, 10,000 families have been distributed land titles. According to him, the records of about 12 to 15,000 squatters and unorganized settlers have been entered into the computer.
He informed that the land titles were distributed in collaboration with the local level and the records collected by the commission are as accurate as possible. Similarly, based on the initial information collection, records of 1.2 to 1.5 million squatters and unorganized settlers have been collected. He said that all these details prepared by the commission will be easy for the new government. The current government after the Gen-G movement has not yet made public a clear blueprint for solving this problem.
The government is being criticized for forcibly evicting squatters living in various places in the Kathmandu Valley, including Thapathali, without proper management. Former chairman Niraula says, ‘We had signed an agreement with the Kathmandu Metropolitan City in 2079 to collect details of squatters in Kathmandu, including Thapathali. Since that work was at the local level, we did not have to interfere.’ But the metropolis sent a dozer without collecting the details. The commission had a different opinion on that.’
