During the discussion that began on 2053 Paush 6 on the no-confidence motion filed by a faction of the CPN-UML and the Rastriya Prajatantra Party against Prime Minister Sher Bahadur Deuba, an uncomfortable situation arose due to rostrum gherao, rule-breaking, accusations and commotion. At the beginning of the meeting, the ruling Congress had surrounded the rostrum demanding that Speaker Ramchandra Poudel answer the question of dismissing two Sadbhavana Party MPs, Hridayesh Tripathi and Anish Ansari, from their posts. The Congress had questioned the Speaker Poudel after he had informed him of the action taken against the Sadbhavana MPs, but the matter could not be resolved. In the meeting, the ruling and opposition parties had their respective positions on the issue of the MPs. Speaker Poudel's office was also vandalized, saying that no decision had been taken on their matter. UML and RPP MPs participated in the vandalism.
Congress MPs had surrounded the rostrum of the House of Representatives demanding information about the action taken by the Sadbhavana Party against two of its MPs as the number of MPs fluctuates during the vote on the no-confidence motion. The Congress demanded that action be taken against Sadbhavana MPs Tripathi and Ansari, who were taken action against by the ruling party MPs.
Sadbhavana Party had already informed the Speaker that it had expelled Tripathi and Ansari from the party due to disciplinary action. Sadbhavana President and Minister for Supplies Gajendra Narayan Singh had demanded his dismissal as he had already informed the Speaker that he had taken action against them and expelled them. After Singh objected in the meeting, opposition MPs raised a ruckus saying that a minister was not allowed to object.
Amidst the ruckus, Singh had said, ‘Some MPs from our party have left the party and joined the opposition.’ In accordance with the Constitution and the House of Representatives Rules, a notice should be issued that the membership of MPs Tripathi and Ansari is vacant.’ The Speaker was informed that the two MPs who won the election from Sadbhavana were expelled from the party for signing the no-confidence motion moved by UML and RPP while still in the government and sitting on the opposition bench. The opposition said that action should not be taken against Tripathi and Ansari of Sadbhavana, who stood in favor of the no-confidence motion. However, there was a dispute between the ruling and opposition parties in the parliament, saying that Speaker Poudel had not taken the process forward in their case. The ruling party MPs objected to the fact that Ansari and Tripathi were not expelled, while the opposition objected to the fact that the minister’s resignation was not accepted and the parliament was not informed of it. The meeting was started after three hours. Speaker Poudel initially allowed the leader of the main opposition party, Manmohan Adhikari, to speak. But Congress MPs, led by the ruling Congress chief whip Anand Dhungan, went to surround the rostrum. Poudel had urged the MPs to stay in their respective seats. But the Congress MPs demanded answers as questions were raised about the two Sadbhavana MPs.
Speaker Poudel adjourned the meeting for an hour. But the meeting was adjourned for three hours. The ruling party MPs had said that the House of Representatives Members' Regulations 2048 BS provide for the termination of office if they voluntarily resign from the party from which they were elected. The opposition party, however, had argued that the regulations would not apply as there was no law on party resignation. UML Chief Whip Devi Prasad Ojha had said that the demand to terminate the office of an MP was unconstitutional.
Inconclusive all-party meeting
After the adjournment of the parliament session, the parties continued to exchange accusations during the all-party discussion called by the Speaker. Opposition MPs had alleged that there was a conspiracy to prevent the no-confidence motion from being tabled under the pretext of expelling the Sadbhavana MPs. UML Parliamentary Party Chief Whip Ojha had maintained that the issue of Sadbhavana MPs would not be discussed in the parliament. However, he had said that they were ready to hold informal discussions outside the parliament. After that, Speaker Poudel formed an informal committee consisting of 5 members each from the ruling and opposition parties for legal advice. After saying that the issue would be discussed only the next day, UML Chairman Manmohan Adhikari tabled the no-confidence motion.
RPP dispute in the house
The biggest disagreement in the power equation occurred within the RPP. After the UML promised to give Lokendra Bahadur Chand the prime ministership, the RPP was divided into two camps, one to sustain and the other to topple the Deuba government. The direct evidence of this was seen in the House.
Especially, the MPs and ministers divided between Chairman Thapa and the parliamentary party leader Chand had objected and violated the rules. Minister Fattesingh Tharu of the Thapa party had questioned whether ministers from the same party could sit on the ruling and opposition benches in Parliament. He said that the party had not given any 'indication' to sitting in the opposition and that the House would not be allowed to function unless it was resolved.
In his response, MP Kamal Thapa of the Chand party had said that the minister himself had created chaos by not following the decision of the parliamentary party. He had said that party Chairman Surya Bahadur Thapa had violated the decision of the central committee and the parliamentary party. He had accused the Speaker of obstructing the legal path by violating the whip of the parliamentary party. Minister Prakash Chandra Lohani and Padmasundar Lawati had made statements refuting each other's statements. Lohani had stood in favor of Speaker Thapa and Lawati leader Chand.
Speaking in the parliament meeting, Education Minister Govinda Raj Joshi had said that the seat allocation should be done through the Speaker's ruling. Speaker Poudel, on the other hand, said that the issue should be resolved by the party, saying that it is not right to tell the MPs to go here and there. Poudel had said, 'According to the rules of parliament, the ruling party should sit on the right and the opposition should sit on the left. It is a matter of the party, and they should come to a conclusion and sit together.'
Speaker's office vandalized
Speaker Poudel's office was vandalized on the same night as the parliament meeting was obstructed. RPP and UML MPs broke the glass of the table and vandalized the table and chairs. The opposition MPs behaved like this because the meeting scheduled for Poush 20 was postponed to the 21st.
The vandalism took place in the presence of RPP MP Kamal Thapa, UML's Bamdev Gautam and Radhakrishna Mainali. Speaker Poudel was surrounded for two and a half hours in their presence. After an attempt was made to attack the Speaker, the MPs were marshaled and taken out. Poudel had informed that the meeting was postponed because time was needed to discuss the issues of Sadbhavana MPs Tripathi and Ansari. But the opposition MPs did not listen to him.
Poudel added, ‘If I am attacked when the meeting is postponed for a day, I will stay here alone all night, you can do whatever you can.’ Law Minister Bhim Bahadur Tamang had said that the attempted attack and vandalism on the Speaker was condemnable.
