UML had filed an impeachment motion against Chief Justice Bishwanath Upadhyay and Supreme Court Justice Surendra Prasad Singh in the Parliament Secretariat on October 1, 2009, raising questions about their efficiency. The impeachment motion was filed, particularly after the Supreme Court overturned Prime Minister Manmohan Adhikari's recommendation to dissolve Parliament and hold mid-term elections, raising questions about the efficiency and impartiality of the judges.
After the Supreme Court restored the parliament on Bhadra 12, 2052, the UML was angry with the judges, including Chief Justice Upadhyay. Less than a month after the verdict, Chief Justice Upadhyay retired on Bhadra 8, 2052. Singh was appointed as the Chief Justice after Vishwanath in the order of rotation. The UML had registered a motion to impeach Singh before his appointment as the Chief Justice. The UML had registered an impeachment motion against Singh in anger over the postponement of the mid-term elections.
The impeachment motion registered in the parliament was not formally processed by Speaker Ramchandra Poudel, calling it irrelevant. However, UML MPs had been insisting that the impeachment motion should be discussed, saying that Speaker Poudel had supported the ruling party. The parliament could not function regularly for almost a month and a half, demanding a discussion on the impeachment motion. The ruling party, on the other hand, had been saying that the impeachment motion was brought to seek political revenge against the Chief Justice. Due to the long-standing stance of the ruling and opposition parties on the issue of impeachment, accusations and infighting continued between the parliamentarians. However, the UML had decided to withdraw the impeachment motion in the parliament meeting on 25 Kartik 2052, saying that the judiciary should be impartial, respected, and the judges should have character. UML Chief Whip Devi Prasad Ojha had said that he had withdrawn the motion against Chief Justice Singh, saying that he had taken special time in Parliament to participate in the People's Movement 2046 and actively contributed to the drafting of the current constitution, expecting reforms in the judiciary.
Speaker Poudel had earlier said that an agreement had been reached on the basis of a package deal. After Poudel informed the House, UML MP and Chief Whip Ojha said that his parliamentary party meeting had withdrawn the impeachment motion. He had said that the decision to withdraw the motion was made after a long discussion in the party meeting. He did not provide information on how and under what conditions the motion was withdrawn after a month-and-a-half of controversy. Ojha had informed the House that he had decided to withdraw it after discussing the impeachment at the party's parliamentary party meeting.
Although the Speaker said that the impeachment motion was withdrawn as a 'package deal', the UML leaders did not clarify on what conditions they withdrew it. The question was raised as to what would have been the result of not allowing the House to proceed for a long time if there were no conditions.
