Left parties along with the ruling party filed a petition in the Supreme Court against the Prime Minister's recommendation to dissolve Parliament.
What you should know
Political parties including the ruling Congress were demanding the restoration of the dissolved House of Representatives. Even if mid-term elections were to be held, the Left components were adamant on the demand that Girija Prasad Koirala should be removed from the post of Prime Minister and an all-party government should be formed.
The left-wing parties were doing the Nepal bandh movement in stages. However, the King did not show many positive signs towards the demands of the parties for the restoration of the House of Representatives or the formation of an all-party government. Yes, the King asked Prime Minister Koirala about the questions raised by the parties and the constitutional provisions, but he seemed to want to make a new decision based on the legal provisions only.
In this background, left-wing parliamentarians and leaders of the ruling party approached the Supreme Court demanding the restoration of the House of Representatives. Hari Prasad Nepal and Ganesh Pandit, MPs of the disbanded House of Representatives and political activists Durga Subedi and Lokkrishna Bhattarai registered a writ in the Supreme Court on July 11, 2051, demanding the restoration of Pratinisiva.
On the recommendation of Prime Minister Koirala, the king had announced to dissolve the House of Representatives and hold mid-term elections on October 27, 2051. Street protests and legal door knocking were being practiced. ![[Archive] This is how the issue of dissolution of parliament reached the Supreme Court](https://assets-cdn.kantipurdaily.com/uploads/source/news/kantipur/2025/miscellaneous/2051-4-12-2782025112423-1000x0.jpg)
After Ramraja Prasad Singh, president of Janwadi Morcha, announced the concept of restoration of parliament, Subedi and Bhattarai decided to register a writ petition based on his arguments. In the writ petition, it was mentioned that after resigning from the post of Prime Minister, it was wrong to dissolve the Parliament and go for the mid-term elections. It was mentioned in the writ that the basis of the recommendation of the mid-term elections is flawed. It was mentioned in the writ that the unauthorized recommendation should be canceled from the order of dispatch.
After discussions with senior legal professionals including Krishna Prasad Bhandari, Vasudev Prasad Dhungana and Sindhunath Pyakurel, Constitutionalist Dr. The writ petition was drafted with the efforts of Surya Dhungel, advocates Sushila Karki, Borna Bahadur Karki, Shrahari Aryal, Baburam Giri. In the writ, it was mentioned that despite the situation of forming a stable government, it was deprived.
It was done in a writ of objection that there is no legal and constitutional provision to dissolve the House of Representatives when the session has not ended. "When the Speaker informed that the meeting of the House of Representatives will be held the next day on June 27, 2051, the dissolution of the Parliament on the previous day has caused an attack on the supremacy of the Parliament," the writ said. Petitioner Subedi stated that according to the principle that 'constitutional monarchy does not do anything wrong', he filed a writ petition only against the unconstitutional recommendations of the Prime Minister and not against the King. The writ was registered against Prime Minister Koirala, Election Commission, Constituency Determination Commission and Council of Ministers.
The majority MPs of the disbanded House of Representatives had prepared to appeal to the king with the demand for the restoration of the parliament. For that, preparations were made to gather former MPs at Pragya Bhawan. The UML leaders informed that about 135 former parliamentarians signed the petition. At least 50 former MPs of the ruling Congress were expected to sign. As Congress General Minister Mahendra Narayan Nidhi has signed a joint statement to move forward with the 6 left components, it was almost certain that the petition would also be supported . Nidhi had submitted a petition to the king demanding the restoration of the House of Representatives and the removal of Koirala.
The news prepared by journalist Taranath Dahal by including the context of the issue of restoration of Parliament from the street to the Supreme Court was published by Kantipur Daily on 12th July 2051 under the title "Suit filed for restoration of Parliament". The issue reached the Supreme Court when the 6 left constituents with the support of the founding party of the Congress were holding a street protest demanding the restoration of the House of Representatives and the formation of an all-party government.
