The case of death of UML General Secretary Madan Kumar Bhandari and Jivraj Ashrit in a jeep accident in Dasdhunga on 3rd June 2050 has been in discussion for a long time in Nepali political circles.
At that time, the government formed a one-member commission under the chairmanship of former additional judge of the Supreme Court, Prachandaraj Anil, to investigate the jeep accident in Dasdhunga on June 4, 2050. Similarly, UML also constituted a commission on May 5, 2050 under the chairmanship of standing committee member and MP KP Sharma Oli to investigate internally.
Oli commission was also said to have submitted the report to the party on 3rd June 2050. The then General Secretary Madhav Kumar Nepal held a press conference and gave a summary of the Dasdhunga jeep accident report prepared by the Oli Commission and said, "The accident is not natural due to the driver Lama's physical and mental condition, post-mortem report, eyewitness statements, and the driver Lama's repeated attempts to lie."
The decision of the Anil Commission formed by the government was termed by the Oli Commission as completely one-sided, misleading and untrue. What is mentioned in detail about the accident in the Oli report has not been made public yet.
The issue of the accident became more complicated after the conclusions of the report submitted by the Anil Commission formed by the government and the Oli Commission formed by the UML did not match.
UML had continuously raised the demand that another commission should be formed under the chairmanship of a sitting judge of the Supreme Court in order to replace the Anil Commission. The movement across the country took a violent form to fulfill the demand.
After the loss of human and material structures during the agitation, the government led by the then Prime Minister Girija Prasad Koirala recommended to King Birendra to form an inquiry commission under the chairmanship of the sitting judge. But a case was going on in the Chitwan court against Amar Lama, the jeep driver who had an accident in Dasdhunga.
UML accused Amar Lama of having all the information about the jeep accident and accused the government of being weak in the investigation.
Under the pressure of the UML movement, the government recommended the king to form an inquiry committee under the chairmanship of a sitting judge of the Supreme Court. But the king understood that the matter was serious and asked for an opinion from the Supreme Court .
The Supreme Court had given an opinion that the case of Chalak Lama is pending in the Chitwan District Court and cannot be re-examined. But it was advised that there is a constitutional provision that the king can give permission for other investigations of Dasdhunga, except the driver lama.
The opinion was given by the then Chief Justice of the Supreme Court Vishwanath Upadhyay, Judges Surendra Prasad Singh, Trilok Pratap Rana, Gajendrakeshari Banstola, Om Bhakta Shrestha, Keshav Prasad Upadhyay and Krishnajung Rayamazhi.
Raja asked the question whether a commission under the chairmanship of a sitting judge of the Supreme Court can be formed under Article 92 to re-investigate the facts related to the accident according to clause (5) of Article 88 of the Constitution of Nepal 2047. The Supreme Court also gave an opinion that if the commission was to be formed, a law should be made to regulate the procedures and powers of the commission.
The death of Madan-Ashrit, the commission demanded by the UML movement and the news prepared by the National News Committee (RASS) based on the opinion given to the king by the Supreme Court, Kantipur called 'Dasdhunga accident: The incumbent judge had published on August 23, 2050 under the title of 'not to be investigated'.
