Civil Bill: Discussing the provision of 'cooling period' and vacation, which are linked to the interests of employees

The parliamentarians themselves have started saying that the interests of the chief secretary, secretary and joint secretaries have prevailed over the 'Bill, 2080 to regulate the formation, operation and conditions of service of the federal civil service', which is being discussed in the state system and good governance committee under the House of Representatives.

After the interests of the employees prevailed, a dispute has arisen as to which points of the final draft report of the bill should be discussed and which should not be discussed.

A meeting of the State Affairs Committee was called after 8:00 am on Sunday morning for 'Discussion on the final draft report of the Committee regarding the Bill, 2080 to make provisions regarding the formation, operation and conditions of service of the Federal Civil Service'. In the meeting, committee secretary Suraj Kumar Dura was made to read the draft report. When it was time to read point number 33 of the report, Secretary Dura said, 'We will read it later'. When the MPs were puzzled as to why it was said to be read later, point number 41 of the report came to be read . Committee secretary Dura also said, "Let's read later."

When the committee secretary Dura said that the two main controversial points of the bill were put forward, Congress MP Hridayram Thani asked, 'What happened to these two points?' The secretary of the committee who was reading the report stopped and the chairman Khatiwada replied, 'When the retirement age of the civil service is changed from 58 to 60 years, what remains is how to use it and how long the cooling period will be kept.' Is it possible to talk about those issues or not? When Thani countered, Chairman Khatiwada said that MPs can speak during the discussion.  In point number 33 of the

report, the retirement age of federal civil servants will be increased from 58 to 60 years and its implementation method is mentioned.

The chief secretary, secretaries and joint secretaries, who are going to retire within the next one year, have been pressuring the committee that they should apply two years at once to extend their job tenure . The committee is trying to implement an additional period of two years of leave, initially 6 months, then one year and then 6 months. The chief secretary and secretaries have said that the parliamentarians are trying to raise the age from 58 to 60 at the same time with various arguments, including the saving of state funds. A cooling period has been arranged in point number 41 of the

report. The parliamentarians have tried to keep the system of not getting appointment in constitutional, diplomatic and political positions for a certain period after retiring from the high position of the federal civil service . But the chief secretary and secretaries are putting pressure on the committee chairman and members from the prime minister and party leaders saying that the cooling period should not be kept under any circumstances. According to the parliamentarians, through Prime Minister KP Sharma Oli, Home Minister Ramesh Akhtar, Foreign Minister Arju Rana Deuba, recently appointed Education Minister Raghuji Pant, Congress Chairman Sher Bahadur Deuba and Maoist Chairman of the main opposition party Pushpa Kamal Dahal, the committee members are being pressured to be flexible during the cooling period and to listen to the employees when the retirement age is raised from 58 to 60.

In the final draft of the committee on the cooling period, it is written, 'Civil servants or employees who have retired from other government services will not be appointed to any constitutional or government post until one year has passed from the date of retirement.' Earlier, under the pressure of the Chief Secretary, Law Secretary and the Law Secretary working in the Prime Minister's Office, there was no cooling period for becoming a judge and ambassador. The committee has also backed down after criticism that the system discriminates against employees.   

Congress MPs Sarita Prasai, Hridayram Thani, Ambika Basnet, Ishwari Neupane and others have demanded that a cooling period of 2 years be imposed in the meeting. Committee Chairman Khatiwada has also personally said that he is in favor of a 2-year cooling period.

Congress MPs have also said that there should be a cooling period of at least 2 years in the amendment of the bill. MP Neupane said that she thinks that the Constitution Committee has become helpless in relation to the Civil Bill. She opined that the chief secretaries and secretaries in high positions should not be forgotten and should be discouraged from making arrangements with the political leadership to get another appointment on the verge of retirement. He said that laws should not be made by looking at the faces of the employees. MP Ambika Basnet said, 'It should be accepted that it came from the public service to implement the vacation age by making it 60 years . A cooling period of 2 years should be made to prevent setting . I don't think the implementation of the holiday and the cooling period should stall the bill.'

What is the objection when Congress MP Prasai keeps a cooling period of 2 years? She questioned the ministers and secretaries. 'My personal point is that the cooling period should be kept for 2 years . What comes to the government will be in its place, my personal opinion should be kept for 2 years,' she said . She said that since the chief secretary and secretaries make arrangements to appoint ambassadors and others during their vacations, they should break the arrangement with the political leadership by keeping a cooling period.

Member of Parliament Chitra Bahadur KC said that the strongmen have done many activities to insert their interests in the bill . He objected by saying that the opinion committee of independent employees was not heard. There is a controversy about the cooling period. Some have tears in their eyes and eat, but in the kingdom they have killed, some will not get anything . Preparing for another as soon as you retire? With 1 year and 6 months remaining, what is the bad intention of going to another place to kill?,' he said.

Maoist MP Hitraj Pandey said that the cooling period should be kept for 2 years . He said that at least 2 years of cooling period should be kept for the development of the country. RPP MP Wise Tamang said that while discussing the Bill, 2080, which was created to regulate the formation, operation and conditions of service of the federal civil service, the employees were affected. "Employees should not have a trade union." If it has to be kept, it has been said whether it will be kept officially until Subba . The parliamentarian who registered the amendment also said that it should not be kept. However, we did not listen to MPs, experts and public servants who proposed the amendment,' Tamang said. Live at the level of policy making and live in the trade union? In front of the personnel system, the MP will not be worth anything . It's not the head wagging the tail, it's the tail wagging the head.'

Congress MP Thani said 'cooling period should be done for 2 years in any case, no one should compromise'. He said that the tradition of going to another position without retiring from one place should be broken. Based on the temperature and pressure, the cooling period should not be one year. Even a person who seeks appointment does not lose his relationship with the political leadership in 1 year . It became clear that which leader is appointing whom, it should be kept for 2 years to control it . It is clear what kind of inclination the person going through the appointment has with which political person . After keeping it for two years, the front ones will come,' he said.
