On 31 Chaitra 2081, the Patan High Court had acquitted Judge Giri in a rape case filed by his ex-wife Aarti Rawal Giri.
A joint bench of Justices Lal Bahadur Kunwar and Dilli Ratna Shrestha had acquitted him. He was arrested and detained after his wife accused him of marital rape. The Kathmandu District Court and the Patan High Court had ordered Judge Giri to be released on bail, but the Supreme Court had ordered Giri to be remanded in custody for the duration of the trial on 21 Chaitra 2080. The district court had ordered Giri to be released on a date, and the high court had also upheld the district court's order. After that, Giri's ex-wife Rawal sat on a hunger strike in the Supreme Court. After consuming poison in the courtroom during the debate, the Supreme Court ordered Giri to be kept in custody and the case to be tried. He was suspended immediately after the case was filed, but returned to his duties after the higher court acquitted him. In the case, the Kathmandu District Court had found
guilty in 2081 Jestha and ordered
to be sent to custody. The district court sentenced Giri to seven years in prison and a fine of three hundred thousand rupees. Giri appealed against the district court's order in the Patan High Court, while the District Attorney's Office, Kathmandu, also appealed for a reduced sentence. After the hearing on the appeal, the higher court overturned the district court's order and acquitted Giri. Rao had filed a complaint against him for having sexual relations without consent and forcibly raping her even after the divorce. A case was filed based on the same complaint.
