Attorney General's Office refutes controversy over teenager's egg extraction

Attorney General Savita Bhandari was embroiled in controversy after she decided not to prosecute a private company, Hope Fertility and Diagnostics Pvt. Ltd., accused of extracting and selling eggs without the consent of the teenager's parents.

The Attorney General's Office has denied any involvement in the allegations of removing and selling a teenager's ovaries.

Issuing a statement on Friday, the Attorney General's Office claimed that since the Attorney General is not in a position to make a decision on whether to prosecute the case, the Deputy Attorney General has been asked to make the necessary decision on whether to prosecute the case and that the decision was made on October 31 not to prosecute the case presented at the Deputy Attorney General's level based on the files and evidence. 

'The decision not to prosecute the case was made on the basis that the matter was not clearly prohibited under Section 66 of the Child Act, 2075, including the offense of violence against children and sexual abuse against children,' the statement said. 'We inform you that the news has published otherwise without studying the facts, evidence and legal basis collected from the investigation of the case and  has no role in the Attorney General's decision.' 

Attorney General Savita Bhandari was embroiled in controversy after she decided not to prosecute a private company, Hope Fertility and Diagnostics Pvt. Ltd., which was accused of extracting and selling eggs from 16-17-year-old girls without their parents' consent. She had decided to grant immunity when she was the direct leader of the conflict of interest case.

A complaint was filed with the Central Bureau of Investigation against Dr. Swasti Sharma under the Children's Act, 2075 BS.

The investigation was completed and the investigation report reached the Attorney General's Office via the District Government Attorney's Office.
