If successful in registering the land according to the 'setting', the agreement between the middlemen who will share it, also the middleman Suraj Lama's signature on the paper
In the audio of Federal Affairs and General Administration Minister Rajkumar Gupta discussing the bribery transaction, there is also a case of a land in Pokhara. Where the middleman says, "The land of Pokhara is sitting staring at us, Minister, why are we sitting here like this?"
This is the lychee garden seen in the picture of 'Pokhara's land sitting looking at Minister Gupta and the middleman' pointed out in the
audio dialogue.
After crossing the KI Singh Bridge over the Seti River to the north of Pokhara, you will reach the point where Lamachaur and Batulechaur separate. From Dobato there is a road to Lamachaur on the left and Batulechaur on the right. After reaching a little higher, there is a thick lychee plantation between these two roads. It seems that the minister and the middleman are involved in scamming billions of rupees by bringing this litchi plantation in the name of the person they want.
As claimed with audio in the complaint submitted to the authority, the middleman Sujan Lama arranged the matter with the minister. According to Malpot employees, Lama, who is also a UML leader, has been working for two years to register litchi plantations.
In a public audio, Lama says that he is ready to pay Minister Gupta Rs. Ramchandra Adhikari, Head of Lamjung Malport Office, was given a bribe of 53 lakh rupees to transfer the cash and a complaint has been filed with the authority along with the number of the said note. Behind these two 'deals', there is a plan to register the land worth billions of rupees in Pokhara-16 Batulechaur under the name of exempted land registration.
Lama, who started politics from Amalenikat Aneraswawiyu, became the Gandaki state member of the party last time.
In the convention held in October 2080, he was defeated as a provincial member. The provincial general secretary of the Federation of Tribal Tribes, he has recently been active in buying and selling land. According to the officials of the Land and Survey Office, the gang Lama has been operating in Kaski to register public land in the name of exempted land registration. He has mobilized leaders, employees and even gangsters to register public land. At the same time, he made a plan to kill the land of Batulechaur.
The said land is a land that was acquired by the Ranas in the past. In the year 1979, during the reign of the famous Noorpratapjang Rana, Rudrashamsher gave his birth in the name of his two daughters Lokdivyashwari and Durgadevi. Birta was abolished in 2016. Even though there is a provision to convert the land acquired through raker, it is not seen that the Rana family has done so. Lokdivyashwari was married to Khemvikram Shah of Palpa Tansen and Durgadevi was married to Tek Bahadur Shah.
Since 2017, Thakali, who has descended from Mustang, buys land from the Rana family based on a deed and sets up a settlement. On the other hand, Lokdivyashwari Shah and Durgadevi Shah filed a case of forgery and written badr against 6 people including Hariprata Jang Rana. The judgment of the Kaski court on 29 March 2031 and the judgment of the then Western Division Bench on 3 January 2040 ruled in favor of Lokdivyaswari and Durgadevi. Mustangi, who enjoyed the rights until 2032, will get Lalpurja in his name after Napi comes in 2033. Land is sold. In 2059 there is a new measure.
According to Chiranjeevi Paudel, chief land officer of Kaski, no one seems to have come to register the exempted land in 2036 and to implement the decision even though it has already passed. The settlement in Batulechaur has been filled. "Someone else has done the encroachment, there is no name of the Shah family in the field book, there is no receipt of the tiro payment, the court has not confirmed the area," he says, "in such a case, the judgment can only be implemented if the court decides to set the quota and cancel it." It appears that a petition has been submitted for the execution of the judgment at the Malpot Office. According to the sources, the application was submitted to the Malpot office with the activism of middleman Sujan Lama.
Durgadevi Shah passed away on 5 Baisakh 2059 and her husband Tek Bahadur had already passed away. In the petition submitted to Malpot, there is a demand to cancel the registration of the land registrations of the land numbers 25, 26 and 28 within the 4 parcels mentioned in the court's decision.
Earlier on 9 August 2080, Mrigendra Malla, becoming the heir of Lokdivyashwari's son Bharatavikram Shah and his wife Chumman Shah, submitted an application to the Malpot Office. On the said application, the registration was rejected as the process was not completed. According to the court decision, the Ministry of Land Reforms and Cooperatives has sent a letter to the Land Management Office on 12th June 2080 to implement the decision to determine the land and bring it to the rightful owner.
Durgadevi's grandchildren filed an application on 24th January 2080 on the same day that the land was registered, and it was also found in the agreement that the land was divided between the middleman and the established rights holders. In the contract registered at the ward office of Pokhara-16, it is mentioned that Dev Bahadur Malla and Yamkumari Gurung of Syangja will bear all the expenses incurred in registering the land.
Geethadevi, Suraj and Sunil Thakuri are said to get 33 percent of the land that has been successfully registered. It is mentioned in the agreement that Yamakumari Gurung will get the remaining 40 percent and Dev Bahadur Malla will get 27 percent. The name of the middleman Suraj Lama is mentioned in the witness of the agreement.
It seems that after Gita Devi and others submitted a petition, the Land Port Office Kaski wrote a letter to the Surveyor Office Kaski on 29th December 2080 to prepare and send the details along with the field book, plot register and map. But for a long time, the survey office did not send the details. After Malpot wrote another letter on 18th June, Napi sent the details on 23rd June. In the reply sent by the surveyor, it is stated that 'the map number mentioned in the decision is not the plot number according to the map prepared by the then surveyor Goshwara, but the map number according to the sketch prepared by the respected court, so after comparing the sketch and the judgment in the office, it is not possible to confirm that the plot number of the land is according to the said map number and because of this, it is difficult to prepare a definite description of the condition of enjoyment'.
District Administration Office Kaski also expressed interest in this matter and wrote a letter to the Malpot Office, and the Malpot Office has sent a reply to the administration. The land office has informed that among the lands within the court's judgment and petitions, Lot No. 119 and 120 of Batulechaur 1, Durgadevi Shah has been mentioned in the survey map, other than that, the names of various people have been recorded in the field book of other lots and have been registered at the same time. The Malpot Office has mentioned that the petitioners do not have any rights or enjoyment in the lots other than lot number 119 and 120.
In the decision of the court, the plot number is mentioned instead of the map number, the sketch made when preparing the bond was not prepared with any measurements, the name of Shah surname was not mentioned in the field book, the name of the land owner with Shah surname was not mentioned in the field book of the same place in 2059, except for the mentioned land, it has been clarified that even the surveyor could not send the details, so the petitioner's demand cannot proceed.
According to the land office source, middleman Sujan Lama was employed to register the land in the 'setting'. He had access to Ranjita Shrestha, the then Minister of Land Management and President of the Civil Liberties Party, through Ramchandra Adhikari, the head of the then Land Port Office, Kaski. Lama was also active in the transfer of employees of the Malport office.
The officer who became the head of Kaski Malpot on 20 December 2079 was transferred on 24 November 2080. In his place, the Ministry of Land Management sent the current chief, Chiranjeevi Paudel, to Kaski. But the officer who had access to the then Minister Shrestha found him dead within two days. Paudel returned to the ministry as the head of Kaski Malpot for just one day. When he had to be transferred within two days, Gokarnamani Duwadi, the then secretary of the ministry, showed his helplessness by saying that he could not do anything.
The Ministry of Land Management fell to the UML with the change of government despite the fact that the official got a reprieve. UML's Gupta became the General Administration Minister. On 21 December 2081, the officer was transferred to Lamjung. In his place, Chiranjeevi Paudel came to Kaski as the chief. The officer filed a petition in the Patan High Court demanding that he should be allowed to stay for two years as he had only stayed for 16 months. The court refused to issue a 'stay order' saying that it would be 2 years if it is attached with a hinge.
After seeing that Paudel would not help in the land registration, Lama's team again tried to bring the officer to Kaski. He started running the ministry by 'offering' bribes to bring Kaski to the officials and also to bring Khem Pun, his favorite, to the chairman of the Land Commission. The audio of the same sequence has now been released.
UML leader Prithvisubba Gurung is considered to be a member of the Gandaki state committee. He had previously been defeated twice in Pokhara-32 as ward president. Pun and La are close due to tribal confederation and party affiliation. Khem Pun's name was not in the list of 5 people recommended by UML Kaski for the appointment of Land Commission Chairman. The provincial committee also added his name and sent it. But Land Management Minister Balram Adhikari appointed Bain Bahadur Gurung from the Khagraj Adhikari side as the chairman of the commission.
After the provincial committee sent the name, he again says that he is not capable of paying the amount even though he is the natural claimant. "I didn't give money, I didn't say that I will give money, the minister is not even someone I know," he says, "This is an audio made by AI technology, let the government investigate, let the party also investigate." Even in
, he does not admit that the voice is his. He claimed that he met Minister Gupta only 1-2 times and that he was not in a position to give the money. He also alleged that the audio was made by AI. He was going to say that until the Minister was attacked for bringing the Civil Servants Bill. He said, "I heard that the court has decided, but I don't know anything else."
He also claims that he is not close to former minister Ranjita Shrestha. However, Kaski Malpot sources say that Minister Gupta and Shrestha were taken by Lama to show them the lychee plantation land. Complaints have come to our office that Lama has cheated others to register public land.
Ramchandra Adhikari of Pokhara-33 Bharatpokhari started his job as a typist Khardar. He got the facility of 24 days and became a branch officer and became a deputy secretary. While staying in the mountain, he was also the chairman of the Nepal National Employees Organization, which was close to the Maoists. He also expressed his ignorance about the complaint filed in the authority saying that he did not take any decision in the case of litchi plantation land when he was the head of Malpot in Kaski. "I said that it will not be stopped if it is according to the prevailing law," he said, "I have no information about other matters." "Other people used to come more than the rightful owners of the land," he said.
Locals submitted a memorandum to the Malpot Office and the District Administration Office on 16 Baisakh after someone else tried to usurp their Lalpurja land. In which there are signatures of 34 local people. It is mentioned in the memorandum that unknown and suspicious people come and threaten the land where they have been enjoying the rights for a long time, the owner of the land also has the evidence and they are living there. "Though we own the properties of the petitioner, we have doubts that they will make us homeless by manipulating internally," said the memorandum.
Prime Minister in discussion, authority confused
Prime Minister called the minister in the afternoon and talked, but did not take action, on the contrary, the cabinet meeting with him in the evening
Even though the complaint was filed on June 10, the authority did not call the minister to give a statement, after all-round pressure increased in the audio 'lab' test
Prime Minister Oli called Minister Gupta on Monday and spoke to him after the pressure increased. But there was no decision or initiative to dismiss Gupta's ministerial post or take action against him. On the contrary, in the evening, Gupta along with other ministers also entered Baluwatar with Sanban, participated in the cabinet meeting.
Prime Minister Oli, who never gets tired of claiming that he has a policy of zero tolerance towards corruption, keeps saying that he will not even look at the face of a corrupt person. He has been saying, "I do not do corruption, I do not allow others to do it, if I am found to have done any corruption, I am ready to give a statement not only on this earth, but also before Chitragupta."
Prime Minister Oli, who kept repeating these words after his speech, had to see the face of Minister Gupta, who is also the leader of his own party UML, who had dealt with bribes twice on Monday. In the afternoon when he called for inquiries and in the evening at the cabinet meeting. Prime Minister Oli did not give any indication of firing Gupta or forcing him to resign. Instead, he quickly finished the cabinet meeting in 45 minutes. At the beginning of the
meeting, the agenda was presented, discussions and decisions were made immediately. One of the major decisions of the meeting was to form a committee under the leadership of former high court judge Krishna Giri to investigate Sharad Ojha, chairman of Nepal Insurance Authority. The government was not satisfied with Ojha, who was the president from the Congress quota. According to the ministers, Prime Minister Oli announced that the meeting was over soon, saying that he had work to do.
On the other hand, the investigation officers of the authority said that it will be easy to proceed with the investigation after the "lab report" of the audio. On June 10, a complaint was filed with the authority saying that Minister Gupta was involved in the bribery case. Almost three weeks after the complaint, the audio material has been sent for lab testing.
"A cursory look at the context of the audio and its vested interest, even though it is in the name of giving land to squatters and landless people, its underlying purpose is connected to the phenomenon of eating/grabbing government/public land," says an officer of the authority, "In this, leaders/employees, middlemen and interest groups work together to embezzle government property, give land to squatters in the name of squatters, and accept bribes in the same way. The current audio is also the same. Maybe, there will be a subtle investigation, if the crime is confirmed, the person involved will be brought to the scope of action.'' According to the official, this bribery dialogue can be dated 28 December 2081, considering the details and context mentioned in the
audio. According to him, it is assumed that the place where the bribe was 'dealt' may be the minister's quarters in Bhainsepati. In the 9 minute and 13 second conversation between Minister Gupta, a middle man and a woman, they are heard being casual and comfortable with each other. Earlier, when KP Sharma Oli was the Prime Minister, the then Minister of Communications Gokul Baskota was involved in the bribery 'deal' case for the purchase of 'security printing' equipment. At that time, a complaint was filed with the authority along with the audio of the bribe conversation.
But the authority granted immunity to Baskota from the case in 2077 on the pretext that "evidence was not found to confirm that Baskota took bribe". The complaint was put on hold.
Parliamentarians' demand to relieve Gupta
MPs from the opposition and the ruling party also demanded in Monday's meeting of the House of Representatives to relieve Minister Gupta from his position and to proceed with the investigation. The leader of the main opposition party, Pushpa Kamal Dahal, said, "Your ministers are openly dealing with lakhs of rupees." Prime Minister, where are you going to give a statement to Chitragupta? Where there is government, there is corruption and corruption. He accused the prime minister and ministers of trying to fulfill the interests of middlemen.
UML MP Kiran Kumar Sah also demanded the government to dismiss Minister Gupta from the Parliament meeting. Sah, who is also the Chairperson of the Women and Social Affairs Committee of the UML, questioned the government's silence regarding Minister Gupta's 'deal' of bribery. "Why is the government silent when the audio of General Administration Minister Rajkumar Guptaji's bribe dealing has been made public?," he said. I demand through this House, Gupta should be sacked and a fair investigation should be conducted.'
Power partner Congress General Minister Gagan Thapa also called on the Prime Minister from a public platform to fire Minister Gupta. "I expected the Prime Minister to fire the minister immediately, I didn't think it was necessary to comment on that, but the situation has come," said Thapa, "I want to request the Prime Minister, fire your minister immediately." Thapa said that after the question was raised in public, the truth should be investigated and Prime Minister Oli should make the environment easier by dismissing the minister. "Who else is involved in this, if there are any, it is too hasty to comment on anyone, if anyone seems to be guilty, action should be taken," he said. His answer was in the House of Representatives meeting where he and none of his subordinates were present. Maoist MP Madhav Prasad Sapkota asked the minister, "The audio of the Minister of General Administration has arrived. In that audio, the minister has made serious accusations against the officer as well. If it is not the involvement as you said, why has it not been refuted till today and why has there not been a satisfactory answer? In the
reply, the Minister Adhikari claimed that there was no irregularity in the selection of the chairman of the land problem resolution commission of Kaski district or other districts. Something has come up in connection with our ministry and me. In terms of making the commission or any members of the commission, not only me, but my ministry and any person related to me, if any such transaction and deal has been done somewhere, please bring the reality, we are ready to take legal action. I request you not to kill someone's character and defame them by making unnecessary noise.'
