In Muskan Hospital, which was opened without registration, Dr. performed a gallbladder removal operation without an anesthetist. Allegation against Gyan Kumar Sah
24-year-old Angesh Kumar Yadav of Sarlahi Haripurwa was seen in a tired state in the premises of District Police Office Dhanusha on Tuesday afternoon. He looked worried when he was found with a complaint in his hand. Mrs. Pavita Kumari Yadav, who underwent gallbladder surgery, has not regained consciousness even after four months and four days have passed.
98 days have passed since he was admitted to Kathmandu Medical College (KMC) in Sinamangal, Kathmandu for further treatment. However, it is not yet decided whether his heart will be opened or not. He returned home three weeks ago as there was no way to pay for his stay in Kathmandu, hospital expenses and medicine. He wants to file a death case against the doctor and the hospital who put his wife in a 'coma'. However, the police could not register it due to legal complications.
Angesh and his family have come to Dhanusha police station from Haripurwa four times. Every time, the police have returned them under the pretense that they are investigating. That's why Angesh came this time with his uncle Birendra Adhikari and father-in-law Brahmadev Rai Yadav who work in the medical field.
On Tuesday, Angesh was the first to reach the office of SP Narahari Regmi. The security guard said to come after 30 minutes saying that the meeting was going on inside. Then he reached the office of DSP Varun Bahadur Singh. His office was locked from outside. Ani Angesh's uncle Birendra took him to the court. Tried to understand about the complaint registration there. Police Inspector Sagar Karki reiterated that the investigation is underway. Angesh's uncle Birendra was not convinced by his answer and asked in a soft voice, 'Sir, when will the case be registered?' Police inspector Karki said that the document and NMC number will be sent to the Nepal Medical Council and the case will be registered only if the hospital and the doctor are found guilty.
In this way, the police is hesitating to take action against the manager of Muskan Hospital and the doctor involved in Pavitha's treatment who operated the hospital without registration. Angesh's father-in-law, as the petitioner, has requested action along with compensation as he has violated Sections 230, 231 and 232 of the National Crime Code 2074. However, the police is in confusion whether it falls under its jurisdiction or not.
Article 230 of the prevailing National Criminal Code states that 'unlicensed persons shall not be treated', while Section 231 shall not be treated with indignity and Article 232 shall not be treated negligently or fraudulently. Angesh has accused Pavitha of deliberate negligence by the doctor and the hospital by operating without an anesthetist in an unlicensed hospital . Therefore, lawyer Rinkumari Yadav says that there is a legal basis on which the police can take action against the culprits by attracting all three points. SP Bhuvneshwar Tiwari, who is aware of the
incident, has been transferred. Newly arrived SP Narahari Regmi said that he is understanding about the incident and will proceed with the registration process after discussing with the Chief Minister. The matter has been brought to the notice of the Chief Minister. We will discuss with him once and do what can be done,' he said, 'The action is under the jurisdiction of the Medical Council and nothing can be said until there is an instruction from there.' In the beginning, the hospital owner was in contact with the victim, but now he is not in contact with anyone, so the problem has arisen, he said. However, they assured that they are on the victim's side and will support whatever path the victim takes. As I understand it, the hospital operator is trying to get rid of the case by paying a lump sum. According to that, in the beginning, one/two lakh rupees was also given," he said, "Now, if he doesn't see salvation, he will be out of touch. I will also coordinate with the police to take the initiative to advance the investigation process.'
Her father Bramhadev Rai said that 30 lakh rupees have been spent on Pavitha's treatment so far. He said that due to lack of money and the lack of KMC hospital, there is no sick person in the hospital for three weeks. He said that the hospital is making regular payments. "We have already paid the money for the treatment," he said, "Now even if we sell the entire property, we cannot pay for the hospital."
Prada, the medical director of KMC Hospital. According to Meena Thapa, only 1000 rupees has been deposited in the name of Pavita, who has been kept in the ICU ventilator for 98 days. There is a total deposit of Rs. How much more will the hospital see?' She said, 'Since the patient has not been sick for three weeks now, the nurses are feeding him by themselves. We don't have a system to give food to patients. If something happens to the patient tomorrow, we will be blamed.' She said that now the hospital has no choice but to formally entrust the police.
Prof.Dr. According to Thapa, Pavita is still in the ventilator in an unconscious state and she is being fed through a tube. Along with that, the hospital is also providing the necessary medicine.
He was admitted to Muskan Hospital in Janakpur on January 3 to remove the gallbladder. On the same day, he was taken into the operating room and sedated, and he has not regained consciousness since then. Pavitha's surgery Dr. working at Muskan Hospital. It was done by Gyan Kumar Sah. Anesthesiologist is a must during surgery. However, the hospital has not been able to clarify which doctor used the drug to make Pavitha unconscious.
According to a doctor who has seen Pavitha's treatment records, it seems more likely that 'hypoxic brain injury' occurred due to a mistake while giving her anesthetizing medicine. "We couldn't say that much, but brain injury has occurred due to lack of oxygen in the brain, and the reason for that is that it happened below when anesthesia was given," says the doctor. What was the amount of oxygen in the patient's body throughout the operation? All this has to be monitored. Of which there is no detailed information. It is not sure whether the anesthetist was present during the operation.
Pavita was kept by Muskan Hospital for three days to regain consciousness after the operation. Then on January 6, he was transferred to Janaki Health Care. After being kept in Janki for 27 days, after her condition did not improve, Pavita was initially taken to Veer Hospital in Kathmandu by being placed in an ambulance with a ventilator. However, Veer was referred to Kathmandu Medical College (KMC) in Sinamangal as ICU beds with ventilators were not available.
