The ruling National Independent Party has a provision in its statute that the post of parliamentary party leader will automatically become vacant if the party does not follow the chairman's guidelines. The statute passed by the first national general convention held in Chitwan from 20 to 23 Asad has a provision that the post of parliamentary party leader will become vacant if the chairman's guidelines are not followed.

The chairman of the Rashtriya Swatantra Party is Ravi Lamichhane. He was elected as the chairman unopposed by the general convention. The leader of the Rashtriya Swatantra Party's parliamentary party is Balendra Shah. According to the agreement between Chairman Lamichhane and Shah on 20 December, the party would be led by the chairman and the government by a senior leader. According to the 7-point agreement, the senior leader would lead the government.

The party statute has a provision that the post of parliamentary party leader will automatically become vacant if the chairman's instructions are not followed. (c) If he leaves the party or is expelled from the party.

(d) If he loses the vote of confidence within the relevant House of Parliament while leading the government.

(e) If he does not follow the policy guidelines given by the party chairman in accordance with 11 (a) (a) (3) of this statute.

(f) If a recall or no-confidence motion is passed against him/her in the parliamentary party.

Section 11(a) of this statute provides for the functions, duties and powers of the party chairman. Section 11(a) of the statute states that the chairman shall coordinate with the parliamentary party. It is written in the statute, 'To coordinate ideologically, policy-wise and politically between the party and the parliamentary party. In the absence of the party chairman as the leader of the parliamentary party, to provide the parliamentary party with the necessary policy guidelines for the effective representation and implementation of the party's official policies, principles, decisions and viewpoints in the parliament. It shall be the mandatory duty of the parliamentary party, the leaders and members of the parliamentary party to follow such guidelines.'

According to the provisions of Section 68(1)e of the statute, the post of parliamentary party leader will automatically become vacant if the policy guidelines given by the chairman are not followed. Similarly, a provision has also been made to 'recall' the leader of the party's parliamentary party. Even if the party is recalled in this way, the post of party leader will automatically be vacant.
