A case has been registered against Sapana Tamang, who was sentenced to life imprisonment for her involvement in the murder of a girl after kidnapping, and her father Min Kumar, along with her boyfriend Subash Shrestha.
Based on the investigation conducted by the District Police Complex, Kathmandu, a case has been filed in the court for the escape of prisoners, and Tamang and 3 others have been made defendants in the escape case.
Tamang, who was serving her sentence in the Central Jail, Sundhara, escaped at around 1:20 am on 1 Jestha. The investigation conducted by the Valley Crime Investigation Office found that she had jumped from a ladder made of vegetable crates and water drums on the wall behind Building No. 4 of the Women's Prison.
The defendants, including Tamang, were arrested by the police and handed over to the District Police Complex, Kathmandu. Based on that, the District Government Attorney's Office, Kathmandu, filed a chargesheet against Sapana, Sameer and Min Kumar under the Prison Act, 2079.
In her statement taken by the police in the presence of the government lawyer, Sapna revealed that she had been thinking of escaping from the prison for a long time. She said that she had been storing plastic crates of vegetables near the prison wall for 5/6 days with that intention.
According to her, on the night of 3rd Jestha, at around 1:20 am, after all the prisoners were asleep, she used the crates as a ladder and climbed the wall. She escaped by climbing over the fence and wall while the police on duty were on their rounds. She then reached Thamel and called Sameer and his father Minkumar from an unknown person's mobile phone.
She admitted that she had told Minkumar, "Take me to where your son is." Her son Sameer used to come and go to the central prison.
Her mother Seema Thapa Shrestha used to work in the prison's factory along with Sapna. According to the police, Samir's mother was the ringleader of the pressure cooker bomb blast that took place in a church in Kathmandu's Dhobighat on 9 Jestha 2066, killing three Indian citizens and injuring 13 others. Samir and Sapna met while visiting the same mother.
Sapna had also gone out of jail during the Gen-G movement to meet Samir. Their love blossomed at that time. After escaping from prison for the second time, Minkumar reportedly took her to the Bangemuda dera in Kathmandu where her son Samir lives. However, he claimed that he helped her because she said he was released on bail.
Samir also claimed that Sapna, who had reached her room at night, told her that she was released on bail. After that, he claimed that they spent 2 days looking for work in various places in Kathmandu and Lalitpur. ‘It was a mistake to take the escaped prisoner with me like this, I am ready to face punishment according to the law,’ said Samir. Investigation revealed that they were looking for work in Satdobato, Khumaltar and other areas.
The police have also made the father and son defendants, saying that Sapna, Samir and Minkumar had frequent phone calls, that Samir used to visit them in prison, and that they hid Sapna in their own dormitory after she escaped, and that they helped her escape.
The charge sheet states that Sapna Tamang committed the crime of escaping from prison under Section 49(1)(b) of the Prison Act, 2079 BS, and that Samir and Minkumar helped in the escape of prisoners under Section 49(2). According to the said provision, a person who escapes from prison can be punished with imprisonment for up to five years or a fine of up to Rs 50,000 or both.
Anyone who escapes or assists in the escape of a prisoner is subject to imprisonment for up to 3 years or a fine of up to 30,000 rupees or both.
