The Property Investigation Commission is going to bring all former office bearers/members and joint secretaries and employees of all levels above them under the scope of investigation.

Similarly, in the case of employees who have worked as heads of offices, up to the level of deputy secretaries will also be brought under the scope of investigation. In the case of former office bearers who have worked in constitutional bodies, if they have been dismissed or removed from their posts, they will also be brought under the scope of investigation.

The provisions related to the jurisdiction and working procedures of the Property Investigation Commission were published in the Gazette on Thursday. In which, the jurisdiction of the commission formed to investigate the assets of office bearers and employees who held public positions/positions of profit from the period 2062/63 to 2082/83 has been specified.

In the case of constitutional bodies or the Nepali Army, if a complaint is received from anywhere during the investigation, a provision has also been included to send it to the concerned body for further investigation.  A mandate has also been set to investigate assets hidden abroad. 

‘To collect details of assets in the country and abroad in the names of the following officials who are currently in public office or have retired from office or have been removed from office and their families and to investigate them’  The gazette notification states, "The then Prime Minister, Deputy Prime Minister, Minister, Minister of State and Assistant Minister of the Government of Nepal and the then Government of Nepal, members of the then Parliament, members of the Constituent Assembly acting as the legislature, chiefs and office bearers of constitutional bodies appointed or removed in accordance with the Constitution of the Kingdom of Nepal, 2047, the Interim Constitution of Nepal, 2063 and the Constitution of Nepal, former judges and retired officers of the Nepal Army, gazetted first class or equivalent and above, provincial chiefs, chief ministers of provincial governments, ministers of state and assistant ministers, members and office bearers of provincial assemblies, office bearers of the former District Development Committee and the current District Coordination Committee, chiefs and deputy chiefs, chairmen and vice-chairmen of local levels, heads and employees of Nepali embassies and diplomatic missions, civil service of gazetted first class or equivalent and above, Nepal Police, Armed Police Force Nepal, employees of the National Investigation Department, civil service of office chiefs or those who have served or have served in the civil service, parliamentary service or health service, gazetted second class or equivalent and above." The investigation will be conducted on employees of the Nepal Police, Armed Police Force Nepal, and the National Investigation Department, who are working or have worked in the position of office chief, the Governor of Nepal Rastra Bank, the Board of Directors, the Deputy Governor, the Executive Director, and the employees of the Gazetted First Class or the equivalent and above, the Chairperson, Director, Executive Director, General Manager, Managing Director, Chief Executive Officer, and the employees of the Gazetted First Class or the equivalent and above of the Government Banks and Financial Institutions established in accordance with the prevailing law, the Commissions, Institutes, Authority Boards, Committees, Centers, etc. of the Government of Nepal, the Chairperson, Director, Executive Director, General Manager, Managing Director, Chief Executive Officer, and the employees of the Gazetted First Class or the equivalent and above, the Chairperson, Director, Executive Director, General Manager, Managing Director, Chief Executive Officer, and the employees of the Gazetted First Class or the equivalent and above of the Government of Nepal.

Similarly, it is mentioned that officials of universities, institutes and other bodies that receive grants from the Government of Nepal and employees of the first class or equivalent and above, the President, Vice President, Prime Minister, Chief Justice, Speaker, Chairman of the National Assembly, Minister of the Government of Nepal or the Provincial Government,  Chief Minister of the Provincial Government, Minister of State of the Government of Nepal or the Provincial Government, Assistant Minister or Head and Member of a constitutional body or persons holding similar positions, advisors, personal secretaries, private secretaries or similar officials who have been appointed or have worked without being appointed, whether or not they receive remuneration or benefits from the Government of Nepal or the Provincial Government, will also be brought under the scope of investigation.

While investigating the property, it is mentioned that the matter of illegally acquiring property that is not related to them and their family members, relatives or kin and hiding or sending it in the country or abroad will also be brought under the scope of investigation.
