With the agreement reached between two organizations of non-resident Nepalis that had been divided over the past few years, a long-running series of cases in the Supreme Court is also moving towards an end.
On November 23, Mahesh Kumar Shrestha and Badri KC had reached an agreement to resolve their previous disputes and unite. Based on this agreement, the NRNA has also started the process of withdrawing six pending cases from the Supreme Court. Shrestha, who became the president after the agreement, said that he would now file a petition for the procedural withdrawal of the Supreme Court cases. He said that the Ministry of Foreign Affairs will also write a letter to dismiss the case since there is an agreement between the disputing parties and that the petitioners are also preparing to file a petition.
According to him, preparations are underway to file a petition in the Supreme Court on behalf of the NRNA, the government, and the writ petitioners in a few days. He claimed that the cases would be withdrawn as soon as the file was ordered to be obtained as the file was burned during the Genji movement on August 23 and 24.
Recently, both NRNA groups had split into Shesh Ghale and another group. The Ghale group held separate elections in Kathmandu, saying that it would implement the Supreme Court's decision, and announced that Shrestha had been elected as the president. The NRNA dispute escalated further. Before that, the writ filed by RK Sharma was also under consideration, while the writs filed by Badri KC demanding a halt to the elections were also under consideration. If the NRNA and the government file a petition to withdraw the case, the case will be withdrawn.
Shrestha also said that the work of withdrawing the case will move forward within this week as the NRNA has already set a schedule for the 12th International General Convention and elections on February 23, 24 and 25.
History of the dispute
From the first general convention to the 9th general convention, the dispute in the NRN did not escalate to the point of division. After that, the issue of who would control the NRN drew a deep line of dispute. The working committee of Kumar Pant, elected from the 9th general convention, could not hold the 10th general convention on time. A dispute arose over whether the representatives to participate in this general convention would be selected by the new working committee of the NCC or the old ones. A major dispute was seen in the selection of about 350 representatives out of 3,600 representatives. After the time of the general convention was repeatedly postponed, the 81st meeting chaired by Pant on 1 Magh 2078 BS formed a 7-member high-level committee under the coordination of the then patron Shesh Ghale, consisting of Upendra Mahato, Jiva Lamichhane, Devman Hirachan, Bhawan Bhatta, Ram Pratap Thapa and Kumar Pant.
However, Ghale's high-level committee could not make the selection of representatives without controversy. There was no consensus among the members of the high-level committee, due to which both sides ended up holding separate general conventions.
The long-standing dispute was settled after Chairman Kumar Pant amended the 10th General Convention statute on 20 and 21 Chaitra 2078 BS and agreed to make the chairpersons alternate. At that time, all disputes were settled with the agreement between the presidential candidates Kul Acharya, Badri KC and Rabina Thapa to be the chairpersons alternately. However, the Ghale side did not participate in this. He held a separate 10th general convention, a day before the general convention held by the founding party, on Chaitra 9. It elected a separate working committee under the leadership of Binod Kunwar.
The Ministry of Foreign Affairs granted official recognition to the NRN led by Acharya, KC and Thapa. The Ghale faction had approached the Supreme Court for official recognition, saying that they had held the general convention in their capacity as coordinators of a high-level committee.
The cycle of litigation in the NRN that began after this has now raised hopes that the old rhythm will return.
