Sujan Lama (Tamang), a middleman who said that he has a house in Sukumbasi village of Pokhara-25, Hemza, used to run to Kaski Malpot office every day. He had files in his hand, money in his bag. As soon as he saw an employee, he would say, 'Tell me where you had to be transferred. I have access to the Prime Minister.
Lama used to tell the Malpot staff that he had his man in the Prime Minister's Secretariat. "He used to come every day," said an employee of the Malport office, "he had to hide his legs to see where he would be seen." The officer, who started his job as a typist, became a deputy secretary by using the facility of 24 'D'.
He had no experience in the customs office. He was working as Chief Administrative Officer in Rainaskot Municipality of Lamjung. The Ministry of Federal Affairs and General Administration, through the Ministry of Land Management, Cooperatives and Poverty Alleviation, sent him as the head of Kaski Malpot Office on 20th December 2079. "That's where the weakness of the ministry happened," said the employee, "they sent someone who had no knowledge of the cargo as the head."
Since 2078, Ganga Pokharel was the chairman of Land Commission Kaski. He became the Chairman of Maoist Quota Kaski when Shashi Shrestha was the Minister of Land Management. When Malpot chief officer Parbat was the chairman of the Maoist-linked Nepal National Employees Organization. The commission, which has officers as members, decided to distribute land ownership certificates to 168 people in Kaski till 29 February 2080. The commission played a role in privatizing the abandoned land in the name of providing land to unorganized residents in the need to manage land for landless Dalits and landless squatters.
It was decided to distribute land ownership certificates to 166 people only in Pokhara metropolis. Out of them, 74 are unorganized dwellers and 62 are landless Dalit squatters. The commission decided to give 120 ropani land ownership certificates to 136 people under the procedure for completing the remaining work of previous commissions, committees and working groups, and sent them to the land office in Kaski to maintain the balance. According to the procedure of the commission, in case of landless squatters, only 130 square meters (4 ana) of land can be provided once. But the Pokharel-led commission decided to give more than 4 annas of land to a single person in the name of squatters. On the other hand, it decided to give evidence of up to 15 ropani of one person in the name of unorganized residents.
Ward-level Facilitation Committee and Metropolis-level Facilitation Committee should decide from the collection of landless squatters and unorganized residents to recommending to the Commission. However, in the case of old applications, the land owner can provide evidence directly based on the recommendations of the ward in the case of previous commissions, committees and working groups. It seems that the Pokharel-led commission distributed the land in the name of unorganized residents by catching this loophole in the procedure. The then chief shipping officer is also involved as a decision maker. Dhanraj Acharya, the head of the metropolis, also said that the metropolis was not involved in the decision to give land owner certificates to 166 people.
The commission was abolished with the change of government. UML leader Sujan, who had been monitoring the activities of the Pokharel-led commission, wanted to bring his close UML leader Khem Bahadur Pun as the chairman of the commission. For this, the audio of him going to the minister's residence and "dealing" bribes has been made public. He used to say that he had personally transferred the chief shipping officer of Kaski. The main reason behind this was the registration of public, Guthi and disputed lands in connivance with Land Commission and Lands Officer. The latest example of which is the lychee plantation land of Pokhara-16 Batulechaur.
In 1979, Rudrashamsher Jabara, who was also the chief ruler of Palpa, gave Lokdivyashwari Shah and Durgadevi Shah the land where the current litchi garden is located. Even though Birta was eliminated in 2016, neither of them turned Birta into a racket. From 2017, Thakali from Mustang came and bought land and started living there. There are huge litchi plants in the vacant land. Local Indra Gauchan says that his father bought the land from Rana in 2017 and after the survey of 2032, the land owner is paying the tiro by making a proof.
Durgadevi filed a case in Kaski district court against the then chief of surveyor office, Rajendrajung Rana, alleging that the Ranas, who are her relatives, sold the land fraudulently. In 2040, the Western Regional Court ruled that the land on map no. 25, 26 and 28 belonged to Durga Devi. But after that neither he nor his descendants appear to have pursued the land. Until the death of Durga Devi in 2059, the family members did not show any interest in the execution of the verdict.
Durgadevi's husband Tek Bahadur Shah passed away in 2006. One of his sons died at the age of three, another son died unmarried at the age of 20. Two sons Sher Bahadur and Bhim Bahadur have also passed away. Sher Bahadur has two sons Bhimsen and Om Bahadur, Bhim Bahadur has two sons Suraj and Sunil. Suraj says that he was not aware of the case being won as his father was in India for work. Sources say that Sujan Lama, who was going to Malpot, learned about the verdict from the staff there. It seems that he promised the Thakuri family to bring back the land by setting up other middlemen. Suraj Thakuri claims that Sujan helped his family as he is Sunil's friend.
The Thakuri family filed a petition in Malpot on 24 Jan 080, demanding the execution of the court's decision. As for the land, now the land ownership in the name of other people has become part of the evidence. Sujan was active to get the land in the name of Thakuri family by canceling the shares of those people.
Malpot employees say that the then Chief Malpot Officer Ramchandra Adhikari registered an application that should not have been registered. Malpot employees were also dissatisfied after the arrival of the officer. Deepak Subedi, Dharmadatta Subedi and Dil Bahadur Chhetri, employees of the case division, were transferred after saying that they could not work during his tenure.
