Letter of authority to Ramdev and Balakrishna in Patanjali land case, refusal to come to the statement

In the case of misappropriation of land taken under concession for industrialization in Kavre's Banepa, the Commission for Investigation of Abuse of Authority has summoned Yogi Ramdev, the founder of Patanjali Yoga Peeth and Ayurveda Company, and his partner Acharya Balakrishna for a statement. But both of them have refused to give a statement saying that Patanjali's Nepal chief Shaligram Singh is responsible for the land transaction.

 

Patanjali Yogpeeth has been opened for Nepal since 2015 with about 1 billion 51 crores from research. It has been seen from the investigation that this amount was brought in as a remittance and not under the legal provisions related to foreign investment or social welfare.

Patanjali brought funds through SBI Bank and Everest Bank under the title of  remittance as foreign investment. Rastra Bank is also investigating after it was found that money was brought in from abroad under the title of remittance for the operation of the industry.

According to an official of the authority, a deadline letter was sent to Patanjali in Haridwar, India, for the statement of Ramdev and Balakrishna last February. The answer came in the second week of Baisakh. In it, it is mentioned that since Waresnama Singh was given the work done by Patanjali for Nepal, he will be responsible for the land transaction. 

In an effort to bring all those involved in the land case under investigation, a letter of deadline was sent to Ramdev and Balakrishna, but they have sent a reply saying that Patanjali is working in Nepal through Waresnama and Singh is the one responsible for it, said the authority official.

Patanjali Yogapeeth and Ayurveda Company is registered as a non-profit company in Nepal. Patanjali Yogpeeth, which was registered at the company registrar's office on 20 December 2064, currently has Yogi Ramdev, Balkrishna Acharya, Shaligram Singh, Rajendra Singh and Umesh Sarraf as directors.

When the company was registered, Ramdev, Balakrishna, Mahant Rajendra Das, Rajendra Singh and Shaligram Singh were the directors. Shaligram Singh has been working as Patanjali's Hartakarta in Nepal since its inception. In 2066, the transaction was done through him when land was bought and sold under the restriction exemption.

On 18th January 2066, the Council of Ministers approved the purchase of 815 ropani land in Banepa for the purpose of opening Patanjali Yogadham, Ayurveda School, herbal industry etc. The cabinet meeting on the same day also approved the purchase of 75 bighas in Dang, 300 plantations in Lamjung, 250 plantations in Syangja, 15 bighas in Chitwan, 25 plantations in Dhanusha, 150 plantations in Kathmandu Valley and 40 plantations in Bara-Parsa within 5 years. The purchase and sale of other exempted land has not been investigated. 

After the approval of the Cabinet, Patanjali's Nepal chief Singh bought 593 ropani 5 annas 3 paisa land in Nasikasthan, Sanga, Mahendrajyoti and Chalal Ganeshsthan areas of Banepa. The then Prime Minister Madhav Kumar Nepal, the then Land Reforms Minister Dambar Shrestha, the then Chief Secretary Madhav Ghimire, the then Secretary Chhabiraj Pant and other high officials and employees were involved in the decision-making process of giving approval to the Council of Ministers to buy land with limited exemption. 

On 17 February 2066, Patanjali's Nepal chief Singh submitted an application to the then Minister of Land Reforms, Shrestha, asking for permission to sell the demarcated land. On 3 March, Minister Shrestha took a proposal to the Council of Ministers to allow Patanjali to sell limited concession land, saying 'according to the instructions of the Prime Minister of Nepal'.

Three days later, on 6 Chait, the Cabinet decided to approve the sale of concession land. The then Director General of Land Reforms Department Keshar Bahadur Baniyan sent a letter to the Ministry stating that the decision of the Council of Ministers was illegal on 17th Chait.

The Council of Ministers decided to seek an explanation from Director General Baniyan on 26 March, saying that the approval given for the sale of demarcated land was challenged. Then Banian was removed as Director General on 27 Chait 2066 and given the responsibility to Jit Bahadur Thapa, Joint Secretary of the Ministry, to support the plan to sell limited concession land in a planned manner. On the same day as Director General, Thapa sent a letter to Kavre to give approval for the sale of demarcated land. 

According to the land clearance game, on 11 June 2067, Patanjali sold 353 ropani 15 annas to Kasthamandap Business Homes Pvt. Ltd. In the investigation, it has been seen that funds were embezzled in the purchase and sale of land. 

Patanjali has shown the price of 42.2 million 50 thousand while selling 353 ropani 15 annas land in Banepa. After that, the details of the purchase of 1 hundred and 4 ropani 1 anna 2 paisa 1 dam in Dhulikhel for 1 crore 7 lakh 50 thousand are in the government records. But an officer of the authority claims that the details of the lower figures have been shown to increase the revenue amount by buying and selling for more than 400 million. He says, "It has been shown that 1 ropani land has been bought and sold for around 1 lakh, this is unbelievable." 

The Authority, which has been investigating for a year on the charge of misappropriation of land taken from the government under a limited concession for one purpose, has taken statements from the then Prime Minister of Nepal, the then Secretary Pant, Singh of Patanjali Nepal, the chief decision-maker of the purchase and sale process, and the employees of the Land Administration Department and the Ministry of Land Management who are involved in this process.

The then Chief Secretary Ghimire, involved in the decision-making process, has been missing since 9 October 2073 after his jeep fell into the Trishuli river. The then land reform minister Shrestha passed away on 21 October 2081.
