With the Cabinet’s decision to abolish the 3 percent equality tax imposed on education and health, citizens who previously paid this tax under those headings will now be eligible for a refund. The Cabinet meeting held on Wednesday decided that the 3 percent tax paid on education and health from the 1st of Saun until now must be refunded to the accounts of the concerned individuals or entities within a maximum of 50 days.
According to the Secretariat of Prime Minister Balendra Shah, the Office of the Prime Minister will instruct the Ministry of Finance to arrange for the refund/deposit of taxes paid by citizens up to the 6th of Saun into their accounts within 50 days. The Ministry of Finance will issue a circular or order to its subordinate departments and offices (such as the Inland Revenue Department, Office of the Controller of Treasury and Accounts, or the relevant educational/health institutions).
Within the specified period (50 days), the process of refunding the amount to the bank account of the concerned individual or entity must be completed.
If someone does not come to claim the refund, or if it is not possible to refund the amount to the concerned person due to technical or legal reasons, the Secretariat of the Prime Minister has stated that the amount must be deposited into the government’s consolidated fund as per regulations.
The Office of the Prime Minister has clarified that since Wednesday’s decision is an executive order, it will be implemented directly and does not need to be published in the Nepal Gazette. Accordingly, administrative procedures will proceed directly on the basis of the Cabinet’s decision and the Ministry of Finance’s circular.
