Maldonado, a Honduran citizen, came to the US alone at the age of 17. Maldonado had filed an asylum application with the court seeking asylum in the US as a refugee. His case was pending in court. The Guardian has mentioned that the court issued the deportation order after learning that he had died after failing to appear for a hearing. Maldonado was a mechanic by profession and a father of one.

According to Immigration Rule 239(2), there is a clear provision that the case can be automatically dismissed if the applicant dies. But Judge Amy ruled in the ruling, saying that ‘the defendant did not appear in court despite being given written notice and no specific reason was given for his absence, so the court concluded the hearing in his absence,’ The Guardian wrote.
