Members of the US House of Representatives and the Senate have opposed it. Most have demanded that Trump be removed from office by invoking the 25th Amendment. The 25th Amendment is also trending on social media.
What is the 25th Amendment?
In the US, President Woodrow Wilson needed rest after suffering a heart attack in 1919. However, he did not leave power. Until 1921, Woodrow's wife continued to indirectly interfere in the work of his government.
Post-World War II President Dwight Eisenhower also had a heart attack in 1955. The following year, he underwent intestinal surgery, and in 1957, he suffered a stroke.
He sent private letters to then-Vice President Richard Nixon, and the government acted on that basis. There was no law. This incident sparked a debate about what to do if the president or vice president became mentally or physically ill.
In 1963, President John F. Kennedy was assassinated. Soon after, Vice President Lyndon Johnson was given the executive presidency. This was an emergency. However, this incident further strengthened the debate about legal reform.
The 25th Amendment, which included a measure to transfer power in the event of the president or vice president being incapacitated, was passed by both houses of Congress on July 6, 1965. It was then ratified by the legislatures of the 38 states required. After completing the necessary procedures, it became law on February 10, 1967. According to this amendment, the president can declare himself unable to fulfill his duties and transfer power to the vice president.
According to Article 4 of this amendment, the vice president and a majority of the cabinet members can declare the president incapacitated if they wish.
They send a written letter to the Speaker of the House and the Senate declaring the President incapacitated. Upon receipt of the letter, the Vice President automatically becomes the Acting President.
However, the President can also challenge it. He can send a letter to the House or Senate declaring himself fit for office. Within four days of receiving the President's letter, the Vice President must send a second letter claiming the President's incapacity.
Otherwise, the President will return to office within four days. If the Vice President sends a second letter within four days, signed by a majority of the members of the Council of Ministers, the dispute will be decided by a joint
two-thirds of the House of Representatives. 'The scope of the 25th Amendment is limited. Its main focus is on whether the President is physically or mentally capable of performing his duties,' “The 25th Amendment is not a way to remove a president for wrongdoing,” Michael J. Gerhardt, a law professor at the University of North Carolina, told PolitiFact.
So, while it is technically possible to remove Trump from office this way, it is not a political way.
On the other hand, most of Trump’s cabinet members are his supporters. Vice President J.D. Vance himself is a staunch Trump supporter. Members of the cabinet regularly praise President Trump in cabinet meetings. Similarly, Republican lawmakers in the lower house and upper house have consistently supported his policies.
