This week, the Temporary Protected Status (TPS), which is supposed to be canceled on August 5, has been suspended by the court until the third week of November. The American government agency, the US Department of Homeland Security (DHS), decided to cancel Nepali TPS on August 5. A federal court in California has stayed the cancellation of Nepal's TPS until November 18, so that the DHS decision will not take effect on August 5. After the cancellation of TPS, the stay of citizens of Nepal, Honduras and Nicaragua in the US has been extended by another 3 months. Currently, the stay of 7,500 Nepalis in TPS has been extended by 3 months.

It has been mentioned that Nepali TPS has been stopped till November 18 while announcing the decision on Thursday about the hearing held in the court last Tuesday. For the hearing against the cancellation of TPS, the court has fixed initial case management on August 14, further management on October 8 and preliminary injunction on November 18 at 2 pm. The National TPS Alliance and seven individual plaintiffs filed a lawsuit against the Trump administration on July 7, 2025, to repeal TPS. 

New York's immigration attorney Basu Phulara said that the period of cancellation of TPS of Nepalese may be extended even after November. "Since the court has set a preliminary injunction on November 18, the possibility of the final hearing of the case is very low," he said. Fulara said that most of the TPS bearers are in the legal process for permanent residence in Nepali US, so when the court stayed the implementation of the DHS decision, their stay was extended and some relief was given. He estimates that only about 2,500 Nepalis will be fully affected until the final hearing of the case regarding TPS and the full implementation of the DHS decision. Fulara said that out of 7,500 TPS carriers, around 5,000 are currently proceeding with the process for residency with legal documents. He said that since only 2,500 are in TPS, only they can be fully affected. Fulara mentioned that the future status of Nepali TPS carriers should depend on the final decision of the court.

For the first time in 1990, after the then President George W. Bush introduced the TPS system, 14,500 Nepalis received TPS at various stages. As of December 25, 2023, 5,200 out of 12,07 Nepalis who were TPS carriers had changed the nature of their residence before the start of the term of President Donald Trump. There are currently only 7,500 Nepalese who have not been able to change the nature of their residence and are still in TPS.

On August 5, releasing a press release about Nepal's decision to cancel TPS, the Secretary of DSH, Kristi Noem, said that the US government has provided TPS to those who are at risk for resettlement due to natural disasters, violence, war, and various reasons, especially in the poor countries of the world. "We have started the process of phased cancellation and expiry of the deadline, we have set a date to prepare the legal basis for residence after the end of TPS," she said. Otherwise, it is mandatory to leave the US within the specified time.' This time, out of the 16 who got TPS, it was decided to cancel the TPS of citizens of four countries along with Nepal on August 5. On May 19, 2025, 472,000 out of 7,95,000 Venezuelans had their TPS revoked, according to the list published by the National Immigration Forum. Similarly, it was decided to cancel the TPS of 17 thousand 700 of Afghanistan on 14 July 2025 and 10 thousand of Cameroon on 4 August 2025 along with Nepali. According to the list of

immigration forum, there are 76 thousand from Honduras, 4 thousand from Nicaragua, 474 thousand from Haiti, 8 thousand 200 from Syria, 280 from South Sudan, 7 thousand 300 from Myanmar, 12 thousand 800 from Ethiopia, 4 thousand from Yemen, 4 thousand 900 from Somalia, 232 thousand from El Salvador, 3 thousand 950 from Sudan and 130 thousand 7 from Ukraine. The TPS of 100 people has not expired immediately. In America, 1.1 million citizens of 16 countries including Nepal are currently living in TPS.
