The committee formed to investigate the incident that occurred in the House of Representatives on Jestha 17 has recommended that the Honorable Speaker immediately exercise the special privileges granted to him.

The committee has suggested that, in cases where indecent and provocative language is used, the Speaker should strictly enforce the rules, including removing such statements from the parliamentary record and expelling members from the session as necessary.

The committee has also recommended that the Honorable Members themselves, the Federal Parliament Secretariat, and the Honorable Speaker should take seriously the full compliance with the code of conduct and rules mentioned in the House of Representatives Regulations, which members are required to follow.

Similarly, the committee has suggested increasing awareness regarding orientation and the code of conduct, making the roles of party leadership and chief whips more effective, improving security and technology management, adopting international best practices, activating the Conduct Monitoring Committee, strengthening the human resources and technology of the Parliament Secretariat, enhancing the internal discipline and accountability of political parties, managing precedents, organizing CCTV surveillance and record management, and making the activities of the Business Advisory Committee and administrative facilitation more effective.

To investigate the incident of Jestha 17, the Speaker instructed the formation of an investigation committee during the House of Representatives meeting held on Jestha 18.

The committee consisted of Prakash Adhikari, Secretary of the House of Representatives, as coordinator, and Babita Mishra, Head of the Internal Resources and Planning Management Division, and Gopal Sigdel, Head of the Technology Management Division, as members.

The committee prepared its report by studying on-site records, collecting audiovisual evidence, taking statements from eyewitnesses, and analyzing related documents. The committee was given seven days to submit its report. The committee submitted its preliminary report to Honorable Speaker Aryal on Jestha 25.

The committee concluded that the incident on that day involved a breach of parliamentary decorum, weaknesses in the implementation of regulations, a lack of restraint, and existing managerial challenges.

What did the investigation committee find?

The investigation committee stated that it studied the police report, information bulletins, audiovisual materials, eyewitness statements, and other related documents regarding the incident that took place inside the House of Representatives on Jestha 17. As soon as the meeting began, Prime Minister Balendra Shah raised his hand to request time, and after receiving permission from the Speaker, proceeded to the rostrum and called on members for questions and answers. After that, opposition MPs Yuvraj Dulal and Ain Bahadur Mahara raised objections, stating that Rule 56 of the House of Representatives Regulations, 2083, had been violated.

Subsequently, a question-and-answer session with the Prime Minister was conducted. As the Prime Minister was leaving the meeting, Dhruva Rai and some other opposition MPs stood up in protest. The committee stated that the Speaker took note of the behavior of opposition members and called attention to improving Aren Rai’s language and ensuring the members’ conduct was appropriate.

The committee also collected details of the damage. It reported that the right corner of the table in front of the Speaker’s chair was cracked and the wooden bar attached to the front of the table was broken. The report also mentioned that the right side of the entrance door on the north side of the House of Representatives hall was damaged and the door frame was broken.

The investigation committee stated that if peace, order, and discipline are disrupted or about to be disrupted in the meeting hall, or if any act is committed inside the hall that undermines the dignity of the assembly, or if destructive acts are committed or about to be committed, or if force is used or about to be used, or if any physical damage is caused, the Speaker may instruct the sergeant-at-arms to immediately expel the individual from the meeting hall.
