Now, impeachment motions against the heads and members of constitutional bodies have to be finalized within 5 months. The new rules of the House of Representatives have a provision that the impeachment motion should be finalized within 5 months of its registration.
The Rules Drafting Committee led by Rashtriya Swayamsevak Sangh (RSS) MP Ganesh Parajuli has already submitted a report on the draft of the new rules to Speaker Dol Prasad Aryal.
Earlier, the impeachment motion filed against the then Chief Justice Cholendra Shamsher Jabra had been pending due to lack of time. There was a dispute when the first parliament kept it under consideration and the second parliament did not take ownership. The current rules state that if an impeachment motion is filed when the term of the House of Representatives is less than five months, such a motion can be finalized by adopting an expedited process as determined by the Speaker in consultation with the Business Advisory Committee.
Similarly, it has been said that the impeachment motion that has not been resolved even through the expedited process or is on record will remain on record for the new House of Representatives and the elected House of Representatives must decide within five months of the formation of the House.
