Deuba's side files writ petition, to be heard on Magh 20

A writ petition filed by the faction of outgoing President Sher Bahadur Deuba has been registered against the Election Commission's decision to grant legitimacy to the Gagan Thapa faction of the Nepali Congress. The Supreme Court has registered the writ petition and fixed the first hearing for Magh 20.

The same day, candidacy registration is also underway for the House of Representatives elections to be held on 21 Falgun.

The then acting president Purna Bahadur Khadka has filed a writ petition. The Deuba faction had requested that the writ petition be filed today and heard. However, after the Supreme Court informed them that it was not possible to file the case today and schedule the hearing, they returned after filing it.

Stating that the Election Commission's decision could lead to a situation where two-thirds of the Nepali Congress would be left without a party and deprived of participating in the elections, acting president Khadka and other leaders had filed a writ petition today and requested that the petition be filed today. However, the Supreme Court had replied that it would not be possible today due to the provisions of the rules.

Now, it seems that the Supreme Court will issue an order only after the nomination of candidates. Only if the Supreme Court issues an interim order will there be relief for the Deuba faction, while if it does not issue one, there will be relief for the Gagan Thapa faction, who was elected at the special general convention.
