A writ petition has been filed in the Supreme Court against the decision of the Attorney General's Office to withdraw the money laundering and organized crime cases registered against Rastriya Swatantra Party (RSWP) President Rabi Lamichhane.
Yubaraj Poudel (Successful) filed the writ petition on Wednesday, naming the Attorney General's Office, various district government attorney's offices and Ravi Lamichhane as defendants. The Supreme Court has stated that it is studying whether or not to register his petition.
The decision made by the Attorney General's Office on Poush 30 and the related correspondences have been sought to be quashed by an order of transmission. He has also sought an injunction not to weaken the cases related to cooperative fraud, organized crime and money laundering filed against Lamichhane and not to obstruct the legal process.
The petitioner claims that despite the legal provision that the charge cannot be amended except in cases where new evidence is found as per Section 36 of the Code of Criminal Procedure, 2074, the decision was made arbitrarily with the intention of acquitting Lamichhane.
