The Sher Bahadur Deuba faction of the Nepali Congress has begun legal consultations regarding the issue of the party's legitimacy.

 Deuba and another leader Purna Bahadur Khadka consulted the law on Thursday after submitting an application to the Election Commission on Thursday to update the elected office bearers and members from the special general convention.

Deuba and Khadka consulted with senior advocates Upendra Keshari Neupane, Sher Bahadur KC, Khamba Bahadur Khati, Yogendra Bahadur Karki, Gyanendra Adhikari, and others. 

Neupane said that the process of calling a special general convention and electing the central working committee was not in accordance with the statute. They had said that the process of calling a special general convention was also not in accordance with the law since they had already signed the decision to hold a regular general convention in the central working committee meeting on Mangsir 15.

However, leaders in favor of a special general convention have been saying that the representatives who signed 54 percent of the signatures have called a special general convention after the central working committee did not call it. 'On the one hand, the verification of 54 percent of the signatures has not been done. On the other hand, the schedule for holding a regular general convention has the signatures of two general secretaries. Therefore, the process of calling a special general convention is not legal,' said Neupane, 'On the other hand, the special general convention does not have the right to dissolve the central working committee, which has a term until Jestha. How was the election held without a vacancy?'

He said that the statute provides that only a two-thirds majority can remove the president by proposing a no-confidence motion. Deuba and Khadka had also consulted legal experts about the process and possible decisions to be adopted by the Election Commission. Legal practitioners including Khati, KC had also suggested that the current process was not legal, saying that the special general convention can only discuss policy issues but cannot hold elections for the central working committee whose term is still pending.

Legal practitioners had told about the process by which the Election Commission can do anything from cutting letters to understand the matter to demanding answers.

'There is no room for complacency anywhere. "Sher Bahadurji also says there is no doubt that we will be the official, while Gaganji seems confident," said a central member close to Deuba, "Even if we give official status to someone, it seems that the election atmosphere will be disrupted."
