The second hearing of the writ petition filed by the majority of MPs against the formation of the Madhesh Province government is underway. The case has been scheduled for hearing before a bench of Justices Til Prasad Shrestha and Nripadhwaj Niraula.

The writ petition filed by 74 MPs in the Madhesh Province Chief Minister dispute is about to be debated by both sides. The dispute reached the Supreme Court after the then state chief Sumitra Subedi Bhandari appointed UML MP Saroj Kumar Yadav as the Chief Minister in a hotel.  

The Supreme Court had ordered the submission of the entire file related to the appointment of Yadav as the Chief Minister on Kartik 23 and had also set the hearing date for Sunday. 

A single bench of Justice Nityanand Pandey had set the hearing date for the 30th, saying that both sides should discuss the issue of issuing the interim order sought by the petitioner.  

74 MPs other than the UML had approached the Supreme Court demanding that the decision to appoint Yadav as the Chief Minister be nullified.  Congress parliamentary party leader Krishna Prasad Yadav, JSP Nepal parliamentary party leader Saroj Kumar Yadav, Maoist Centre parliamentary party deputy leader Yubaraj Bhattarai, LOSPA parliamentary party leader Jayalun Rai and other leaders had reached the Supreme Court.

An interim order was also issued last Tuesday in this dispute. The Supreme Court has also asked Yadav, who was appointed as the Chief Minister, not to make long-term decisions.

There are 107 MPs in Madhesh Province. 54 MPs is the majority number to form a government. UML has 25 including the Speaker, Congress 22, JSP 19, Janmat 13, Maoist 9, LOSPA 9, CPN (S) 7, Federal Socialist Party, RPP and Nagarik Unmukti Party have 1 MP each. Among them, UML MP Dipendra Thakur, JSP MP Saroj Singh Kushwaha, and LOSPA MP Abhiram Sharma have been suspended. The current number of members in the Madhesh Provincial Assembly is 104.

The provincial chief administered the oath of office to UML MP Yadav as the Chief Minister early on Monday at a hotel in Bardibas. The dispute reached the court after it was criticized as politically, constitutionally and morally wrong.
