Never injustice to the landless

What you should know

If the spirit of the Gen-G movement is to be grasped, the first task of the Ministry of Lands should be to focus on maintaining good governance in the land and land surveyors offices. But the news of cancellation of land commission has come out. The game of disbanding, canceling and creating another commission is going on after a change of government. This commission has been made the most joke in this country.

There are many agencies that are unable to work, there is no question about them from anywhere, but this land commission is the first target of any government. In essence, none of the government, employees, officials of the commission will be affected. If it belongs to someone, it belongs to the landless.

If not, how will this work be completed? Although it does not matter much to the non-landless, it is a matter of life and death for the landless. It has been seen that the local level is the most affected, they are the ones who collected the tax, they are also the ones who did the measurements, tomorrow the landless and unorganized residents will come to the local level to ask for the land owner. 

According to the Land Commission's website, so far 88,895 applications of landless Dalits, 1,68,441 of landless squatters and 8,72,181 of unorganized residents have been entered in the computerized system. 1,000 surveyors and Amin have been assigned to survey work. Landlessness is profound, the impact is multifaceted 

Landless has also been made into a funny character. To those who have not been able to claim the land they live on for generations, this level of negligence in giving rights to them cannot be tolerated. It is also a joke on the poor. The recent Zen-G movement has also shown that no one can stop the dam of patience when it becomes too much.

Landlessness has many causes. Feudal land system is its source. which has concentrated land ownership in the hands of a few people. This has mainly left Dalits, tribals, ethnic minorities and marginalized groups landless. As a result, poverty, inequality and food insecurity have increased. Many of these families have built temporary or makeshift houses on government land in risk areas.

Access to, ownership and control of land, as well as the right to sell or transfer land, are essential to ensuring basic human rights. Land ownership is the main basis of identity, power, equitable prosperity and political access. 

The mountain of injustice, deprivation and poverty faced by landless squatters is huge. Most of them have to live on unprotected land. Even to get government services/facilities, they have to complete more procedures than those who own land. They have to be deprived of the financial facilities that they get by keeping the land mortgage. Education, health, livelihood, social status are all weak.

As in other countries, landlessness is also a factor of conflict. The contribution of the landless in the movement from 2007 to today is not small. There are also separate movements related to land. The issue of overall land reform, including landlessness, is closely connected with the issue of ensuring Nepal's economic prosperity, stability of democracy and social justice.

Ending landlessness is also a mandate of the Comprehensive Peace Agreement. This is a matter of enforcement of fundamental rights. Under Article 40 of the Constitution, under the rights of Dalits, it is mentioned that the state will provide land to landless Dalits once according to the law and the state will provide accommodation to the homeless Dalits according to the law.

Similarly, under the social justice and inclusion policy in Article 51 (J), a policy has been taken to identify and rehabilitate the free earners, kamalari, hurawa-herdsmen, halia, landless, squatters by arranging arable land or employment for residence and livelihood. According to this provision of the constitution, solving the problems of landless Dalits, landless squatters and unorganized residents is a mandatory responsibility of the state. So it is a matter of constitutional obligation. It is not subject to the whims or whims of any person, organization or government. 

As a fundamental right, ensuring the right to housing is also interrelated with the right to land. It is definitely not the subject mentioned to preserve the fundamental rights of the constitution. This is for implementation. It cannot be justified from any point of view that thousands of citizens remain landless in one country. The problem of landlessness of the Dalit community has been there for 10 years since the constitution was made. Therefore, it seems urgent to break this indifference in the implementation of rights. Stopping the process of getting this right will be more unfair. 

 Let's create a permanent structure. Again, when the next government comes and dissolves this commission, why continue to build it? Let's make a permanent structure of Chustakhal. Let's create a structure that works. The use of the commission to change the government has now failed. Now it's too much. Even the landless and unsettled residents are fed up with this game. Political parties should also review it. Efforts so far have also failed due to political disagreements and selfishness. The parties have failed to give responsibility to those who can do it while keeping the people of the party. As a result, there was no appreciation for those who did something.

It is a humble request - the decision of cancellation has not been made, cancellation is not a solution, let's reconstitute this commission if possible. Let's change people by evaluating work. It is absolutely wrong to do this.  There are also ways to save

resources. Let's keep a small commission in the union and assign responsibility to the local level to do all the work. Even the local level can do it. Let's not have a district committee. The local level can complete all the procedures and prepare the land owner part. The land owner prepared in this way can go to the provision of receiving and approving the land surveyor and surveyor before distribution. But it should be specified in such a way that the goods and surveyors can be approved within 15 days as recommended by the local level. It is very important to ensure that the current work does not stop, otherwise it will become injustice for those who are deprived of land rights.
