Behiti knows no bounds. It has been revealed that 52 ropani land of Bal Mandir has been mortgaged in Nepal Bank. The news that the government land has been mortgaged to the bank is itself an irony of the country. Also, although it is confirmed that the land has been mortgaged by the land office since 2056, no records have been found about how much money was withdrawn, what was the purpose and where the expenditure was spent.
Moreover, it has been found that Malpot has withheld the land of Baal Mandir on 5th June 2050, but the record of this is not with the organization. The land embezzlement of the children's organization established for the care and protection of orphans and helpless children has definitely made civilized society uncomfortable.
Bal Mandir's land embezzlement curtains are opening one after another. Irregularities such as renting for an unnaturally long period without competition, allowing land to be occupied more than the contract, and not keeping a transparent accounting of the amount received for rent have been found to have been committed in collusion between the then officials and employees. As the Abuse of Authority Investigation Commission and the Central Investigation Bureau of the Police are also investigating the matter of land embezzlement, there is a possibility that more cases of embezzlement will be revealed.
The series of land embezzlement of 'Nepal Bal Sangathan' (Baal Mandir), which was established as a public institution in 2021 according to the National Guidance Act, seems to have started in 2049. Even though this series continues till 2072, the silence of the regulatory body is interesting in itself. Meanwhile, the organization was continuously led by Rita Singh Vaidya. Vaidya was given the leadership on 6th Baisakh, 2049 by dismissing the then President Thakur Prasad Mainali with one year left in his term. Soon after he came, the working committee amended the statute so that the land of the organization can be rented and sold. While it was wrong to open the government land acquired by the government in 2021 from the people of Bhimshamsher Jabara.
After the amendment of the statute, the organization leased 9 ropani land to Brihaspati School without competition in 2049. By 2059, Jupiter was allowed to occupy up to 14 ropanis through repeated supplementary agreements. On August 11, 2059, a 30-year (till 2089) agreement was signed to lease additional 13 ropani 12 annas 1 paisa land. With 16 years left to the end of the contract period, it was agreed that the lease period will continue until 2131 years, with an additional 43 years in 2072. Brihaspati leased 5 ropani from the leased land to 'Rai School' from October 1, 2076 to 50 years.
After a dispute between the owners of the organization, it was decided to terminate the lease agreement with Brihaspati for 13 ropani 12 annas 1 paisa land on 14th December 2066. On 28th January 2016, the resource management committee of the children's organization decided to pass the registration to Tarun Nirman Seva without taking the government's consent. After the reconciliation between the two parties on 21st June 2072, Jupiter again got the land. After it was found that the property of Bal Mandir had been exploited to the extreme, the government formed an inquiry commission under the chairmanship of former judge Haribabu Bhattarai and dissolved the Vaidya-led working committee only in October 2076. The conclusion of the commission is that since 2049, the property of the children's temple has been exploited with the connivance of the officials and employees of the then working committee. The authority is investigating based on the commission's report. Regarding the embezzlement at that time, the organization itself and the CIB of the police are also investigating and investigating.
The organization recently decided to terminate the contract with Jupiter, concluding that it was illegal. Since the income source may be affected after the land rent agreement, the government's approval is urgently needed for the operation of the Bal Mandir. The authority and CIB should complete the investigation soon and make everyone involved in the misappropriation of the Bal Mandir land a partner in legal action. Exploitation of land acquired by the government 60 years ago and used for public benefit should be stopped. For that, the law should be amended immediately. Otherwise, under the influence of the middleman, the phenomenon of land grabbing can happen at any time. Likewise, the tenure of office bearers should be fixed for a fixed period. Attention should be paid to the protection of property including land and buildings of children's organizations not only in Kathmandu, but across the country.
