The dispute over the official status of the Congress has once again reached the Supreme Court. Former Acting President Purna Bahadur Khadka and others have filed a review petition against the decision that upheld the Election Commission’s recognition of the committee led by Gagan Kumar Thapa as president. This is the second time the dispute has entered the court.
As the General Convention approaches, the outgoing president Sher Bahadur Deuba’s faction filed a review petition on Wednesday, which the Supreme Court has registered.
Supreme Court spokesperson Arjun Koirala said on Wednesday that the review petition had been submitted and was registered after review. He said it is not yet certain when the next hearing will be held. On 4 Baisakh, the Supreme Court had upheld the Election Commission’s decision to recognize Thapa’s group as official.
Claiming that the decision was flawed, the Sher Bahadur Deuba faction filed the review petition. The petition will now be scheduled before a bench of three judges. If the three-judge bench issues a show cause order, the case will proceed; if not, it will be concluded.
Earlier, a bench of Justices Sharanga Subedi and Nripadhwaj Niraula had ruled that the Election Commission’s decision to recognize the special general convention of the Congress was in accordance with the law.
With this Supreme Court decision, the activities carried out by the current executive committee elected from the special general convention continued to be recognized. After the Election Commission granted legitimacy to the Thapa-led executive committee elected from last Poush’s special general convention, the Deuba group had approached the Supreme Court against it.
On 6 Magh, during a hearing before the single bench of Justice Sunil Kumar Pokharel, the court refused to issue an interim order and instead ordered the respondents, including the Election Commission, to submit a written response.
