The Assets Investigation Commission has clarified that the investigation into assets will not be stopped in the case of others except judges and military officers.
Issuing a press release on Monday, the commission informed that the investigation has been suspended only in the case of sitting and former judges of the Supreme Court and sitting and former military officers and is open in the case of others.
The Supreme Court had issued an interim order in the name of the Assets Investigation Commission on June 26. The statement was issued after there was confusion over whether the work of the commission would be stopped after the Supreme Court issued an interim order and sent the case to the full bench.
The order mentioned the commission as being mentioned only in the case of sitting judges or other officials and employees of the Nepal Army or the Commission who have separate provisions in the constitution as mentioned in the restrictive clause (1) of Article 239 of the Constitution of Nepal.
It has been clarified that persons who have been removed from office after the impeachment motion has been passed pursuant to Article 101, judges removed from office by the Judicial Council, and persons who have been prosecuted under the Military Act, including former judges, who are not under the scope of investigation by the Commission for the Investigation of Abuse of Authority, are to be compelled to submit their property details, and that no action will be taken on the property details submitted by them, and this will not be stopped in the case of other persons.
Since it is not apparent that the order has stopped the collection of property details, investigation, and submission of reports in the case of other officials, the Commission has published a notice accordingly for the information of all concerned.
