The ministries have suggested the creation of 151 laws in the fiscal year 2083/084. As requested by the Ministry of Law, Justice and Parliamentary Affairs, all the ministries have submitted the names of the laws to be created within a year. The Ministry of Law is preparing to prioritize them and submit them to the federal parliament within Asad.
According to Man Bahadur Aryal, Joint Secretary of the Ministry of Law, not all of the proposed laws are for new laws. ‘Most of the list is for amending old laws, and some new bills have to be created,’ he said.
Section 3 of the Legislation Act states that ‘the concerned ministry shall identify the bills to be formulated based on the policies and programs of the Government of Nepal, budget, periodic plans and sectoral policies, and obligations created by international treaties and agreements, and shall send the priority order of the bills to the Ministry of Law by Jestha of each year.’ The list was requested in accordance with this provision.
Similarly, Section 3 (2) mentions that the annual work schedule should be determined by discussing with the concerned ministries and determining the order of priorities, and Section 3 (3) mentions that the annual work schedule should be sent to the federal parliament by mid-Ashar. Accordingly, the Ministry of Law had asked all 18 ministries to submit the names of the laws, and if possible, drafts.
According to Joint Secretary Man Bahadur Aryal, the Ministry of Infrastructure Development has the highest list of 16 laws to be made. Then there are 14-14 under Justice and Parliamentary Affairs and Health and Food Hygiene, 13 under the Office of the Prime Minister and Council of Ministers, and 12-12 under Economy and Culture, Tourism and Civil Aviation.
The target is to make 11-11 under Agriculture, Forest and Environment and Home, 8-8 under the Ministry of Land Management, Cooperatives, Federal Affairs and General Administration and Education and Sports, 7 under Women, Children, Gender and Sexual Minorities and Social Security, 6 under Information and Communication, and 5 under Youth, Labor and Employment. Similarly, there are preparations to draft 4 laws each for industry, commerce and supplies, science, technology and innovation, and energy, water resources and irrigation. One law each is on the list for foreign affairs and defense.
The proposed list includes artificial intelligence (AI), participation of non-resident Nepalis in the secondary securities market, asset management, savings and credit cooperatives, Nepal Science and Technology and Academy of Sciences, chemical substance management, liability of domestic airlines, control of sale and distribution of breast milk substitutes, and surrogacy and IVF.
Minister for Law, Justice and Parliamentary Affairs Sobita Gautam had said that she would expedite the drafting of laws as soon as she assumed responsibility. She had drafted 45 laws in the first phase by initiating discussions with all ministries. While the ministries were preparing their drafts, the list of laws to be drafted in this fiscal year has also reached the Law Ministry.
