The dispute over the writ petition against the decision to appoint the Chief Justice by changing the seniority has been resolved. The Constitutional Bench on Wednesday decided to uphold the earlier appeal.
The bench has upheld the writ petition filed by four people, including advocate Geeta Thapa, against the government's decision to appoint Manoj Kumar Sharma, who is in the fourth position, as the Chief Justice.
The bench's order was upheld on Wednesday, informed Supreme Court spokesperson Arjun Koiral. The bench of Chief Justice Sharma and Justices Kumar Regmi, Binod Sharma, Abdul Aziz Musalman and Mahesh Sharma Poudel made the order.
Earlier, the Supreme Court administration had rejected the writ petition and filed the appeal. The Constitutional Council had recommended Sharma's name, breaking the tradition of recommending the Chief Justice on the basis of seniority in the Supreme Court.
On April 24, the Constitutional Council chaired by the Prime Minister recommended Sharma's name. On June 5, he was approved through a parliamentary hearing and assumed the responsibility of the Chief Justice. The same Sharma settled the dispute on Wednesday through a constitutional bench led by himself.
