The government has not been able to send new bills to the federal parliament. Since the formation of the new government on Chaitra 13, only one bill has been registered in the parliament, except for the budget and ordinance replacement. Since no new bills have been introduced in the parliament, it is seen that the parliament will lack 'business' after the discussion on the budget and its dependent bills is completed. According to the parliament's calendar, preparations are underway to conclude the discussion on the economic bills by Asad 8.
In the annual session of the parliament, known as the budget session, regular bills other than those related to the budget are discussed and passed. 'The priority of this session is definitely the budget.' However, it seems that there will be a lack of parliamentary business after the discussion on the budget is completed,' said an official of the parliament secretariat, 'It is the government's job to provide business to the parliament. However, the bill has not been introduced in the parliament as expected.'
He said that the bills should have been introduced in a hurry according to the government's 100-point agenda, but they did not come as per it. While the Law Ministry has a list of 45 bills that could potentially be registered in Parliament this fiscal year from various ministries. However, there is no bill in a state of readiness to reach Parliament immediately.
The Law Ministry has a list of 45 bills that could potentially be registered in Parliament this fiscal year from various ministries, but there is no bill in a state of readiness to reach Parliament immediately. Two ordinance replacement bills were registered in the House of Representatives on 25 Baisakh. The amendments made by the Sushila Karki-led government to the Voters' Roll and the House of Representatives Election Act through an ordinance for election purposes were registered as bills. The Voters' Roll (First Amendment) Bill, 203 and the House of Representatives Member Election (First Amendment) Bill, 203 have been passed by both houses and have been certified by the President on 17 Jestha. The Karki government had also amended the Special Services Act by bringing an ordinance.
The National Investigation Department was sent to the Home Ministry from the Prime Minister's Office. After the Balen government decided to keep the National Investigation under the Prime Minister's Office, the bill to replace the ordinance amending the Special Services Act was not brought to Parliament. With the ordinance becoming inactive, the National Investigation has automatically come under the Prime Minister's Office.
Similarly, the replacement bill for the 8 ordinances brought by the government last month to amend various acts has not been tabled in Parliament. The proposal to accept/reject the ordinance has also not been tabled. There is a constitutional provision that if no decision is made within 60 days of its presentation in the first meeting of Parliament, the ordinance will automatically become inactive. If the ordinance is not accepted/rejected, the ordinance will automatically become inactive after 26 Asad.
Finance Minister Swarnim Wagle presented the budget in Parliament on 15 Jestha. The financial bills related to the budget have been registered in the House of Representatives. There are 3 bills related to the budget, including raising the national debt, appropriation and finance. Apart from the 2 ordinance replacement bills and the 3 economic bills, only the Nepal Rastra Bank (Third Amendment) has been registered in the House of Representatives. The bill related to the amendment of the Rastra Bank was registered on 11 Jestha.
There are 10 draft bills in the process at the Ministry of Law. Among the bills prepared and sent to the law by the concerned ministries are the draft bills related to domestic air services obligations, amendment to the Passport Act, amendment to the Urban Development Act, amendment to the Building Act, and control of infectious animal diseases. Similarly, draft bills related to the Citizens Investment Fund amendment, mining, federal civil service, amendment to the Reconciliation Act, and prohibition of child labor are in the Ministry of Law for approval. After the law is approved, these bills will be submitted to the Council of Ministers through the concerned ministries.
They will be registered in the Parliament after discussion in the thematic committee of the Council of Ministers and a decision by the Council of Ministers. It seems that these processes will take some time. Spokesperson of the Ministry of Law, Joint Secretary Dal Bahadur Adhikari, says that the concerned ministry can work on the draft bill without taking in-principle consent in the case of bills that were submitted in the previous parliament but became inactive with the dissolution of the parliament. He said that the concerned ministries may be doing their homework on it since the process can be started directly in cases where they were registered earlier and became inactive.
In addition, he mentioned that the ministry has given in-principle consent for the formulation of bills related to artificial intelligence, cyber security, information technology, company law, human body combustion control, Nepal Tourism, Hotel and Mountain Foundation, cooperatives, savings and credit cooperatives. Similarly, the law has given consent for the amendment of the Nepal Rastra Bank Act, amendment of the Nepal Special Services Act, and amendment of the Payment and Forsake Act. Of these bills, only the amendment of the Rastra Bank Act has reached the parliament. Spokesperson Adhikari said that since various bills are in the process of formulation, they will gradually reach the house once the process is completed.
Federal Parliament Secretariat Spokesperson Ekram Giri says that since it is called a budget session, the government's policies and programs and budget will be presented and discussed as the main priority of this session. 'The government may have delayed bringing other bills because the budget is a priority,' he said. 'There are also some bills sent by the National Assembly.' He expressed the hope that after the discussion on the budget and budget-dependent bills is over, more bills will be introduced by then.
An official from the Law Ministry said that it may have taken some time because the new government has revised the previously prepared bills according to its policies and programs and drafted other new bills accordingly. He mentioned that since there are certain processes for drafting the bill, it will also take time. Before drafting the bill, the concerned ministry should prepare a concept paper for drafting the bill and get it approved by the Council of Ministers with the consent of the Law Ministry.
The Legislation Act states that a preliminary draft of the bill should then be prepared and made public to collect public opinion and suggestions. After the approval of the Ministry of Finance, the draft should be sent to the Ministry of Law for approval. After the approval of the law, the concerned ministry should submit a proposal to the Council of Ministers for approval to submit the draft bill to the Federal Parliament. There is a legal process for submitting the draft bill to the Parliament only after the approval of the Council of Ministers.
