The main market area of Hetauda has been in chaos for seven months due to the delay in hearing the case related to the road expansion dispute in the market area.
On November 20, structures were demolished to expand the road in the Hetauda market area. The businesses that were being carried out in the demolished houses and structures have now increased the risk.
The interim order issued by the Supreme Court has now caused further confusion. The Supreme Court, which had dismissed 343 similar cases against road expansion until 2080 BS, has recently given an interim order in some cases, which has affected the road expansion work and has left Hetauda market in ruins. Homeowners in the market area have been demanding compensation, while the Road Department has been repeatedly instructing to clear the road boundary.
The Road Department demolished the structures in the Hetauda market area from Hetauda-Pashupatinagar to Rapti Road and Chowkitol due to the fact that the Hetauda market area falls within the road boundary. Due to the court's interim order, the work of clearing the road boundary, which was started in the winter months, has not been completed even after the rainy season.
The Road Division Office, Hetauda, has left the demolition work incomplete as the case pending in the court has not been resolved. Despite the order to present the writ petition in the Supreme Court in the last time, the case has not been resolved immediately. Hetauda Sub-metropolitan City's legal advisor, Advocate Laxman Mainali, said that the date for the case in the Supreme Court is today (Wednesday).
Hetauda road expansion dispute The homeowners of Hetauda Bazaar, the local administration and the Road Department in Hetauda are awaiting the Supreme Court's verdict on the matter. The dispute has taken a legal form due to the plan of the Division Road Office, Hetauda, to widen the East-West Highway passing through the main market of Hetauda by 25-25 meters and the homeowners' demand for compensation.
Locals including Bindawasini Kansakar had filed a writ petition in the Supreme Court demanding protection of their houses and property during the road expansion. In the case registered against the Division Road Office, Hetauda, Hetauda Sub-metropolitan City and the Ministry of Physical Infrastructure and Transport, a single bench of Justice Meghraj Pokharel had issued a 'show cause order' in the name of the defendants on November 19. The order had temporarily halted the road expansion work.
On Magh 18, a joint bench of Justice Sapana Pradhan Malla and Abdul Aziz Musalman ordered the case to be presented for hearing in the full court. Even though the last time the full court presentation was scheduled for Falgun 10 and Falgun 27, 2082, the case was not listed for hearing. After that, the case has not been presented. Kiran Karki, Head of the Road Division Office, Hetauda, said that there has been a delay in the road expansion and management work because the case is pending in the court. The government has also made arrangements for the road expansion, but he said that there are problems due to legal complications.
There are 531 houses and huts in the market area of Hetauda Sub-metropolitan City during the road expansion. 500 of them have been demolished. 25-25 meters The main market of Hetauda is currently in chaos due to the demolition of more than 500 houses and shacks by the Division Road Office on November 20, within the 9.5-kilometer road boundary from Ratomate via Buddha Chowk to Rapti Bridge (Mahendra Highway) and from Buddha Chowk to Chowkitol (Tribhuvan Highway) during the road expansion. There is no electricity in the main market. It is dark at night. The risk is also the same. The road is dusty. After the Road Department demolished the front part of the house with a dozer, those who built houses behind it and those who own land are rapidly demolishing the houses themselves. After the delay in the court hearing, the demolished shutters are also being repaired and are doing business in a risky place.
The Road Division Office in Hetauda is currently silent as the case has not been resolved. The Road Division Office, Hetauda, has stated that it is unable to proceed with the road expansion and management work due to legal complications. The Road Department, local administration and victims of house demolitions are demanding that the court put the Hetauda road expansion case on the priority list and settle the case.
The Road Division, Hetauda, started the road expansion work by removing houses, huts and structures built in the main market area of Hetauda for the construction of the Asian Highway on November 20 and is currently waiting for the court's order. There is a list of 234 houses, huts and structures to be demolished on the right side of the road and 297 on the left side of the road. Of these, about 500 structures have been demolished.
